Param Bains is a very experienced Senior Junior Barrister with a special interest in all public and private law proceedings relating to children. She undertake a significant amount of work on behalf of Guardians.

Param is passionate and tenacious whilst never losing sight of the need for common sense, sensitivity and courtesy and always remaining cool calm and collected.

Family

Param qualified as a Solicitor in 1993 and spent 5 years as a Senior Assistant Solicitor in a West Midlands Local Authority advising and representing the Social Services Children’s Team. This was a steep learning curve for a newly qualified but a rewarding experience.

She then moved to join the child care law department of a thriving and well respected West Midlands Solicitors firm for 3 years this time representing parents and children in all aspects of private and public family law. Param gained invaluable insight into how legal proceedings actually impacted upon families.

In 2001, Param transferred to the Bar as she recognised this to be her true calling and relished the advocacy. Since then she has gained considerable experience representing all parties in complex and lengthy private and public law children proceedings at all court levels.

Over the years Param has developed a particular expertise in representing the interests of children be it through their Guardian or without their Guardian ensuring that their voice is heard loud and clear.

Re P ( Sexual Abuse- Finding of Fact Hearing) [ 2019] EWFC 27 (Fam) Mr Justice Macdonald

A landmark judgment following a very lengthy Fact Finding;
“It is the expectation of the courts, and the collective expectation of society as expressed through the laws passed by a democratically elected Parliament, that allegations of child sexual abuse will be investigated in an assiduously open minded, procedurally fair and forensically rigorous way. A focus which accords from the outset primacy to the allegation is antithetic to that end. Where the law requires, and will continue to require, proof to a defined standard, derived from admissible evidence, before making findings or pronouncing guilt, such an approach also does a manifest disservice to those who have experienced the pernicious tragedy of sexual abuse, as well as undermining more widely the principle of due process that is a bulwark of a fair and just society” ( Parag 1247)


Re CTD ( A Child: Rehearing) [2020] EWCA Civ 1316 -Floyd LJ, Henderson LJ and Jackson LJ

This case clarified once and for all the approach the court should take at the final stage of a Re Z re-hearing based on new evidence.
