The Employment Group has long-standing relationships with a number of public sector organisations, in particular NHS Trusts throughout England and Health Boards in Wales, local authorities, and police institutions including both the Police Federation and police authorities. A number of our barristers are on the Attorney General’s Panel of Counsel to the Crown. Our members regularly represent educational institutions, care providers, charities, and regulatory bodies.
We have similarly extensive experience of private sector litigation, in particular banking and finance, logistics, energy, sport, manufacturing, and retail.
The core practice of all members in the Group is Employment Tribunal litigation. Our expertise covers all possible claims within that forum, notably:
We have a number of experienced appellate advocates who appear regularly in the Employment Appeal Tribunal (EAT) and Court of Appeal, and up to the Supreme Court. We are committed to access to justice and many of our barristers appear in the EAT pro bono under the ELAAS scheme and other similar organisations.
The Employment Group specialises in employee competition litigation in the High Court. We regularly provide advisory and advocacy services to both employers and employees in claims for breach of restrictive covenants, misuse of confidential information, and team moves, where damages and injunctive relief, including springboard injunctions, are sought. Our members have appeared in a number of significant cases in this field in recent years, including at Court of Appeal level.
We can also assist in employment-related claims in other jurisdictions, such as judicial review claims in the High Court and regulatory appeals in the First Tier and Upper Tribunals.
Outside of litigation, we offer a comprehensive service for investigations. A number of our barristers are specialist, trained investigators who carry out internal investigations on behalf of employers and organisations. This ranges from relatively straight-forward disciplinary and grievance investigations up to high level, intensive whistleblowing, grievance, and misconduct investigations involving senior executives. Our members are also able to chair internal hearings and appeals as independent third parties.
Similarly, our barristers often act on behalf of individuals in professional discipline and other internal regulatory procedures such as for doctors, police officers, teachers, and accountants.
