No5 provides advice and representation to both contracting authorities and suppliers in public procurement matters.

We also provide training to our clients on the implementation of procurement laws and on legislative reform, including the Procurement Act 2023 and the healthcare services provider selection regime.

On the public sector side, our clients include local councils, NHS bodies, multi-academy trusts and central purchasing bodies.

  • Adferiad Recovery Ltd v Aneurin Bevan University Health Board [2021] EWHC 3049 (TCC) – Successful summary judgment application for the Defendant leading to dismissal of an entire public procurement claim; judgment addresses interpretation of common procurement vocabulary, impact of Brexit on below-threshold procurement, implied contracts in public sector tender processes.
  • Bromcom Computers v Academies Enterprise Trust [2022] EWHC 2893 (TCC) – Successful application for the Defendant for further information about a claim alleging wrongful award under a framework agreement; judgment addresses application of CPR Part 18 in public procurement cases
  • Advising – A local authority on compatibility with PCR15 and Concession Contracts Regulations 2016 when creating arrangements to implement Ofgem’s “ECO4 Scheme” for domestic energy-efficiency improvements.
  • Advising – A local authority on compatibility with PCR15 of a proposed collaboration with an NHS Trust to develop and manage health and community facilities.
