Harrison is a member of the Business and Property Group at No5 and acts in a wide range of trusts and estates disputes. He appears in the County Court and High Court on a variety of trials and interlocutory hearings. He acts in small claim, fast track, and multi-track cases at all stages.
Harrison has experience in numerous areas, including Inheritance Act 1975 claims, TOLATA matters, removal/substitution of executors, and disputes as to the validity of wills.
Recent cases include:
• Advised, drafted and appeared in a TOLATA claim concerning a family home which dealt with niche issues such as the valuation of a property classed as a rural enterprise dwelling.
• Acted for the beneficiary of a will in a negligence claim against the deceased’s former solicitors following a failure to sever a joint tenancy.
• Defended a TOLATA claim at trial, where an unmarried cohabitant attempted to assert a beneficial interest in the former family home.
• Successfully resisted possession of a property used for domestic and agricultural purposes. Drafted the defence and counterclaim asserting a beneficial interest in the property by means of a constructive trust.
• Successfully acted on behalf of a beneficiary in the removal of an executor under the Administration of Justice Act 1985.
• Advised on a claim in unjust enrichment and mistake following significant payments made by a pension company to the deceased’s wife.
As a business and property practitioner, Harrison is well-experienced in the crossover trusts and estates disputes have with other areas. Prior to joining No5, Harrison worked as a paralegal to the Chief Executive of a large Midlands law firm, specialising in commercial and banking law. As a result, he has a keen understanding of the business needs of clients.
