Bude - APPLICATION 2008/02281 (PINS REF 2115845)

The Secretary of State's Re-issued decision in respect of the Bude appeal was issued today, 28th July 2011. The original public inquiry was held in March 2010 following which the Inspector, Harold Stephens BA MPhil DipTP, recommended that planning permission should be granted. One of the reasons for so doing was that, based on the housing figures for Cornwall set out in the Proposed Changes for the RS for the South West, there was not a 5 year housing land supply.

In this article I highlighted that the Act is limited in scope and did not offer much guidance on how the Act is to be interpreted and applied. There has also (until my case below) been no judicial guidance on the correct application. The Magistrates Court Guide provided little assistance either....
