Tim Jones obtains planning permission for housing on employment land

Tim Jones successfully represented landowners in High Court proceedings (Lear Investments v Welsh Ministers [2015] EWHC 1532 (Admin)), where he obtained the quashing of an inspector’s decision that refused planning permission for housing on employment land.

He then appeared for the landowners at the remitted s78 appeal (APP/Y6930/A/14/2218029). The appeal was successful and Inspector Alwyn B Nixon granted planning permission to demolish existing industrial units and replace these with residential units.

The Appellant established that the existing employment use was not well sited, that the prospects for significantly improved occupancy of the site were extremely poor, that the LPA’s housing land supply was less than 2 and a half years and that these factors were sufficient to outweigh a conflict with a development plan policy that protected employment sites.
