Andrew Baker and Jas Mann defend in "leaking lager can" affray case

Six men have been spared from going to jail after being part of a brawl in a convenience store.

Wolverhampton Crown Court heard that Roger Flute, 48, Tipton, and his brother Robert Flute, 38, Tipton, entered the Saver Express store on Birmingham New Road, Tipton, with a knife and golf club. They went to the store to support Jamie Chilton, 34, Tipton, who had earlier complained about a leaking can.

A fight broke out between the men and Mohammed Nadeem, 32, Great Bridge, Mohammed Hussain, 34, Yardley, and Asif Hussain, 30, Sparkhill, who run the store. Mohammed Hussain was seen stamping on Jamie Chilton’s head, and Asif Hussain and Mohammed Nadeem also attacked Chilton and Robert Flute.

Roger Flute claimed the knife he had was a form of protection, and Robert Flute said he found the golf club on the way to the store.

Mohammed Hussain was sentenced to 16 months in prison, suspended for two years for affray. Mohammed Nadeem and Asif Hussain were both sentenced to 40 weeks in prison, suspended for two years, for affray.

Jamie Chilton was ordered to carry out 120 hours unpaid work for admitting common assault. Robert Flute was sentenced to 26 weeks, suspended for two years, for affray. Roger Flute was sentenced to four months, suspended for two years, for possession of a knife.
