Development Plans

No5 Barristers have extensive experience of advising and representing clients promoting, supporting or objecting to Local Plans and wider planning policy such as neighbourhood plans and Mineral and Waste Local plans.

The group has assisted a number of Local Authorities through their Local Plan promotion, advising prior to submission, through the consultation process, examination process and, in some cases, subsequent legal challenge. Similarly, we provide strategic advice to developer clients on how best to support or oppose a local plan in order to retain and/or secure allocations within a local plan and, if necessary, how best to derail proposed plans.

Members frequently advise clients in the formulation of representations to local plans and in the build-up to a local plan examination as well as appearing at the examination itself. Members regularly appear in the High Court on behalf of Local Authorities and Developers in relation to challenges to local plans.

Among the plans, members have been involved with in recent years include those at South Oxfordshire (the first virtual EiP), North Hertfordshire, Welwyn Hatfield, Central Bedfordshire, Bedford, the West of England JSP, Birmingham, Canterbury, Melton, Huntingdonshire, Leeds, Nuneaton and Bedworth, Rugby, Solihull, Vale of Aylesbury, Waverley, West Oxfordshire, Wycombe, Chelmsford, Cambridge and South Cambridgeshire, West Sussex, St Albans and the South Worcestershire Development Plan.

We have been involved in some of the leading litigation in relation to neighbourhood planning whilst also acting on behalf of clients at Neighbourhood plan hearings. Some members also sit as independent Neighbourhood Plan inspectors.

The team also has wide experience of advising in relation to Mineral and Waste Local Plans.
