Viewing: Regulatory for Richard Gibbs

Richard rapidly built a strong general practice in crime with a focus upon fraud, proceeds of crime, so called white collar crime and the defence of regulated professionals – in particular police officers and members of the medical profession. He has both prosecuted and defended serious criminal matters at trial in the Crown Court but has a focus upon specialist and regulatory work.
Police/Disciplinary Law
Richard defended a serving police officer in a lengthy fraud case arising from issues connected to the grant of an Enduring Power of Attorney which saw the acquittal of the officer on all of the substantive charges faced by him. He also has experience of representing police officers accused of offences under the Data Protection Act and those accused of motoring and other general criminal matters. Richard has delivered training to West Midlands Police in relation to a range of matters and has worked alongside the Police Federation in several areas representing police offices at disciplinary tribunals.
In addition, Richard is currently instructed on a private basis to defend a medical professional charged with several counts of false accounting and fraud. Richard’s background in heavy weight crime in this area enables him to bring a thorough understanding of the best approach to take at trial in order to best represent clients in this position. He has an extremely detailed knowledge of the disciplinary processes and frameworks in which such professionals operate.
Planning and Enforcement
Richard has represented and advised both local authorities and developers in relation to breaches of planning laws and enforcement notices and has experience of representing local authorities in sentencing and Proceeds of Crime Act applications stemming from planning enforcement notice breaches.
Unfair Consumer Trading
Richard is currently instructed on a private basis to represent a company being prosecuted by Trading Standards with several counts of unfair consumer trading and has recently been instructed by a construction company in a similar trial; both of which will take place in 2019. Further, Richard has successfully represented those charged with offences stemming from breaches of ABTA in relation to various travel matters and the provision of Hajj pilgrimages.
Richard has defended corporate clients faced with prosecution by the Environment Agency, specifically in relation to matters resulting from waste permits.
Private Motoring
Allied to his heavy weight work in the Crown Court in general criminal work, Richard has appeared in both the Magistrates’ Court and the Crown court representing and prosecuting those accused of the full range of motoring offences, from drink driving and driving whilst disqualified through to causing death by either dangerous or careless driving.
Proceeds of Crime Act 2002
Richard has extensive experience of prosecuting and defending both individuals and corporate entities facing confiscation pursuant to POCA and brings expert knowledge as a court advocate as well as a commercial understanding of such proceedings to his work with clients. He has represented clients in the Crown Court and at the Court of Appeal in significant POCA and confiscation matters.
Richard has represented insurers in inquests, frequently as a result of fatal road traffic incidents. His experience of prosecuting and defending cases of death and serious injury through dangerous and careless driving enables him to draw upon a wealth of knowledge to the benefit of clients involved in inquests.
