The context was an insolvency practice where the office holder refused to allow his partner to inspect the office holder files, even in order to establish a true and fair view of the financial position of the partnership. This decision is of considerable procedural importance and (if used) can save significant time and expense. Confidential advice regarding various LLP disputes (lawyers, insolvency practitioners, patent attorneys or otherwise) including formal arbitration and s.994 Companies Act 2006.
Company: Restoring control of a company after records at Companies House had been manipulated without the knowledge of the beneficial owner (1) owner overseas (2) owners deceased. Unfair prejudice petitions.
