Nicholas acts for both claimants and defendants in industrial disease claims and has particular experience of noise induced hearing loss cases. Nicholas regularly appears in fast and multi-track trials. He has substantial experience of dealing with limitation issues as well as expert evidence, including cross-examination of expert witnesses. He is frequently instructed to advise and settle pleadings and questions to experts.
His recent instructions in this area have included: an appeal in relation to the retrospective effect of the restoration to the register of a dissolved company, multiple multi-day trials involving complicated issues of causation and the effect of high-frequency hearing loss on the question of material disability, and, multiple applications in respect of defendant expert evidence.
