Mark is regularly instructed in all aspects of human rights through his work in immigration, asylum and nationality law. Frequently raised in that context are Articles 2 and 3 of the European Convention on Human Rights for those in fear of their safety in overseas countries. Mark has a particular knowledge of Article 8 in the context of deportation, as well as the best interests of the child. Mark receives instructions relating to detention of those facing removal from the United Kingdom which regularly raise issues pertaining to the right to liberty under Article 5. His work in these contexts also involves a thorough knowledge of EU and international law.
Mark also specialises in prison law, with a particular focus on foreign national prisoners. He is regularly instructed in claims as to recategorisation and reallocation, which often raise issues surrounding the right to family life. A regular part of Mark’s work is appearing before the Parole Board, where the right to liberty is central. He also has experience in civil claims against the state for treatment in custody.
Mark has appeared in a number of inquests, representing the family of the deceased and parties implicated in causation of death.
Mark has a background in criminal law, having been instructed in numerous trials, including a high-profile Operation Ore child pornography case with complex jurisdictional and evidential issues arising from the alleged commission of offences in the United States via the internet.
Instructions are received at all levels from Tribunals to the Court of Appeal, including the Administrative Court for judicial review.
