Jorren’s practice focuses on commercial and regulatory aspects of public law, including public procurement, competition and State aid, healthcare regulation and information law.
Jorren also helps public sector clients with commercial disputes and commercial aspects of public contracts.
Public procurement
Jorren represents clients in challenges to public procurement decisions, including:
- defending NHS procurement decisions in relation to healthcare services and construction contracts (including successful application for summary judgment dismissing the entire claim in Adferiad v Aneurin Bevan University Health Board [2021] EWHC 3049 (TCC))
- defending the award of a cloud-based IT services contract for a management information system in the education sector
- challenging a Ministry of Defence award of an engineering services contract
- challenging local authority awards in social care, construction and school catering
- challenging NHS awards in diagnostic services and catering
- challenging a utility company award in relation to pipeline supplies
Jorren also advises on the design and negotiation of public contracts, on the conduct of regulated procurement processes and on amendments to existing contracts. Jorren’s experience includes:
- advising a local authority on variations to the operations and financing of a GBP 500 Million waste PFI project
- preparing tender procedures and contract documentation, including for a local authority insurance procurement and a multi-academy trust IT services procurement
- advising on public authority cooperation arrangements in healthcare, software development and tourism promotion
- advising a healthcare managed services provider on amendments to the terms of a framework agreement
Competition and State aid
Jorren advises on the impact of competition laws on public bodies, including:
- devising a compliance scheme for the publication of market information by a public body compatibly with prohibitions on anticompetitive coordination
- advising on the impact of abuse of dominance laws on the operation of large-scale infrastructure
Jorren also regularly advises on State aid compliance in public sector projects and grant applications – including:
- advising devolved government on the implementation of tech sector policies
- advising on the creation of local authority trading companies in catering and tourism sectors
- advising a local authority consortium on joint investments in renewable energy projects
- advising on university funding applications in medical research, business accelerator programs
- advising on State aid compliance in support packages for struggling care homes
- advising on State aid compliance in new public contracts and amendments to existing public contracts
Regulatory and information law
Jorren has advised NHS bodies on the regulation of medical professionals, on inter-regional cooperation in the carrying out of healthcare regulatory functions, and on the implementation of devolved government healthcare policy. In information law, Jorren has:
- advised on freedom of information and environmental information requests, and represented clients in FOIA and EIR appeals, including in relation to historical archives, planning documents and electoral records
- advised on data protection compliance within the public procurement process
Jorren also has experience of electoral law, having advised on statutory and consultation processes in relation to the review of electoral boundaries.
Public sector contracts and commercial disputes
Jorren regularly advises and represents public sector clients in relation to commercial disputes and commercial aspects of public contracts. Jorren’s experience includes:
- representing a public body in commercial negotiations for COVID-19 emergency venue hire
- representing a public authority in commercial negotiations for the amendment of a waste PFI scheme
- GWE Business West v Bolton Business Ventures (Bristol Commercial Court, 2018): representing successful applicant for pre-action disclosure in relation to use of enterprise grant scheme funds
- Smart Parking v Solent NHS Trust (Manchester Mercantile Court, 2016): representing defendant in 3-day trial of claim for breach of hospital parking contract
- Advising a local authority defending a quantum meruit claim for design and planning services provided during failed post-award public contract negotiations
- Advising an NHS body defending a claim for wrongful termination of a waste management contract, leading to successful settlement
- Advising NHS bodies on the award and implementation of contracts for COVID-19 emergency supplies, assisting in successful resolutions of issues relating to over-purchasing and delivery slippage, and designing a successful general strategy for dispute resolution and settlement
