Property Advice and Conveyancing
Imogen has considerable experience in advising on negligence actions concerning conveyancing and other property transactions, including the failure properly to protect an owner or a borrower’s interest in land. Her recent instructions include being led in a large, multi-claimant, dispute concerning advice given on equity release schemes.
Imogen’s considerable knowledge of the law surrounding property, particularly rights of ownership and the requirements of HM Land Registry, mean she is excellently placed to advise in circumstances where matters have gone awry.
Will Writing and Estates Advice
Imogen’s extensive probate and estates practice has equipped her with the expertise to advise quickly and robustly on matters relating to poorly drafted wills and negligent advice as to estates planning. Her recent instructions include advising upon the negligent drawing up of a settlor-interested trust and the failure of solicitors to sever a beneficial joint tenancy before the death of one of the co-owners.
Surveying
Imogen has previously acted on a valuable negligence action involving the failure of surveyors to spot significant defects in premises before purchase. She regularly advises on the merits and quantum of such claims, particularly in relation to the recoverability of loss in so-called “no transaction” cases.
Litigation Advice
Imogen’s experience of acting in disputes concerning the negligent provision of litigation advice spans from claims relating to the failure properly to defend possession actions, the negligent provision of advice concerning settlement and the failure to pursue appeals. Her knowledge of contentious practice and the procedure of the courts makes her well-placed to advise.
Limitation Issues
Imogen has specific experience of advising and arguing on matters concerning limitation in relation to professional negligence and welcomes instructions on this point of law.
