Inheritance Disputes, Wills Trusts and Estates
Imogen is regularly instructed in contentious probate matters and 1975 Act claims, both at first instance and appeal. Her recent instructions in this area include defending will challenges brought on the basis of lack of capacity, fraud and undue influence; contested applications for the removal of executors and the taking of accounts within estates; and acting for both claimants and defendants in contested 1975 Act applications, including applications for permission to bring proceedings out of time.
Real Estate: Landlord and Tenant
Imogen has a broad experience of landlord and tenant litigation, ranging from contested claims for possession and forfeiture, the renewal of business tenancies, enfranchisement and service charge disputes. She has recently advised on the illegitimate use of service charge funds by management companies and appeared in a multi-day contested trial for possession of local authority housing.
Real Estate: Rights over Land and ToLATA
Imogen’s expertise spans from co-ownership disputes, contested boundary actions, claims for easements by prescription, adverse possession and claims to rectify the register. She has particular experience of matters concerning proprietary estoppel and constructive trust, and regularly appears in multi-day trials turning on these points of law.
Professional Negligence
Professional negligence actions, particularly those relating to property and wills, form a considerable part of Imogen’s practice. She has recently acted in a large, multi-claimant, dispute concerning advice given on equity release schemes and has also advised in other matters concerning services provided before sale of property, such as professional surveys and conveyancing.
Commercial Litigation
Imogen’s practice covers the full range of commercial law, generally with a focus upon contractual disputes. Her analytical mind and attention to detail mean that she is well-equipped to deal with technical disputes and complex legal argument.
