Harrison is a member of the Business and Property Group at No5 and accepts instructions in all areas of commercial, chancery and property disputes. He appears in the County Court and High Court on a variety of trials and interlocutory hearings. He acts in small claim, fast track, and multi-track cases at all stages.
Harrison has extensive experience of claims for possession of property, forfeiture of leaseholds, orders for sale and issues of trespass/adverse possession.
Recent cases include:
• Advised a Defendant to a claim in trespass, counterclaiming for adverse possession of the land.
• Drafted proceedings for possession and sale of a property occupied by an individual under licence following the death of the owner. Harrison successfully represented the estate.
• Obtained an order for sale of a property following the breakdown of a relationship between the parties and establishment of a beneficial interest by the Claimant.
• Advised as to a boundary dispute on residential land, with related issues of trespass, nuisance, and harassment.
• Defended a claim brought in nuisance following the establishment of a right of way in earlier proceedings. Notwithstanding the establishment of the right of way, the Defendant’s actions did not amount to nuisance, and Harrison persuaded the judge any such claim would amount to a Henderson v Henderson type abuse of process.
• Advised, drafted and represented in a TOLATA claim concerning a family home which dealt with niche issues such as the valuation of a property classed as a rural enterprise dwelling.
• Successfully resisted possession for a property used for domestic and agricultural purposes. Drafted the defence and counterclaim asserting a beneficial interest in the property by means of a constructive trust.
Prior to joining No5, Harrison worked as a paralegal to the Chief Executive of a large Midlands law firm, specialising in commercial and banking law. As a result, he has a keen understanding of the business needs facing corporate clients.
