Adam accepts instructions in a broad range of matters relating to real property as well as landlord and tenant. He has a busy court practice encompassing cases from the small claims track to the multitrack ranging from straightforward residential possession claims to complex contested proceedings.
Adam is regularly instructed to provide advice and draft pleadings in relation to disputes relating to residential and commercial property. Adam’s background in financial services gives him a particular specialism in matters that include disputes as to the regulatory status of loan products, mortgages and charges over property.
Adam is also experienced in dealing with disputes over co-ownership of property including TOLATA claims and issues of proprietary estoppel.
Recent work
Advised and drafted pleadings seeking a declaration from the court as to the beneficial owner of a property and that the proceeds of sale belong to one party.
Secured an injunction protecting the proceeds of sale of a property where the client claimed to be the beneficial owner and that the property was sold in breach of trust.
Represented clients, having previously advised as to the merits, and successfully opposed an application for relief from sanctions seeking to revive a claim for possession against the client.
Advised, drafted pleadings and represented a client disputing the regulatory status of a mortgage product.
Advised clients as to the existence of a constructive trust of land and the merits of a proposed claim.
