Adam’s practice covers a broad range of commercial litigation matters including claims for breach of contract and banking and financial services. Adam regularly appears in the County Court and High Court and is frequently instructed to draft pleadings and advise on complex matters relating to commercial and financial disputes.
Prior to becoming a tenant at No5 Chambers, Adam spent five years at the Financial Conduct Authority and has a particular expertise in relation to the scope of the Financial Services and Markets Act 2000 and the associated Regulated Activities Order.
Adam has been instructed to advise on the regulatory status of various investment and loan products as well as on the remedies available for the failure of both regulated and unregulated products.
Recent work
Successfully defended a claim for breach of contract relating to significant fees for early termination. The defendant satisfied the judge that the claimant was estopped from enforcing the contractual terms.
Provided advice to a pension product holder in relation to a proposed claim against a SIPP operator for regulatory breaches after the underlying investment firm were wound up.
Advised and drafted pleadings disputing the regulatory status of an unregulated loan product and setting out the effect of the statutory provisions on the enforceability of the loan.
Advised and represented clients in disputes arising out of the application of the unfair relationships provisions in the amended Consumer Credit Act 1974.
Advised clients seeking to undertake a range of financial services activities as to the scope of the Regulated Activities Order and whether the proposed activity amounted to regulated activity.
