Richard Hignett, Employment barrister at No5 Chambers, recently gave a talk titled ‘Let’s have a chat (‘off the record’)' at the Annual Employment Seminar 2014. 

The admissibility of settlement offers and ‘off the record’ conversations in proceedings before an Employment Tribunal is regulated by:
- the ‘Without Prejudice’ rule
- Section 111A of the Employment Rights Act 1996 (an amendment to the 1996 Act introduced in 2013).
