HS2 – Route Wide Injunction Granted

The High Court (Mr Justice Julian Knowles) has granted High Speed Two (HS2) Limited an interim injunction against four categories of person unknown, and several named defendants. It is a 'route wide injunction'. The injunction order as granted can be found here, and the judgment is available here.

 

In the wide-ranging and comprehensive judgment, the Court reviewed the implications of Barking & Dagenham, the balance of ECHR Articles 10/11 and A1P1, and the status of a hybrid public authorities such as HS2 in the context of ECHR. The judgment will be of particular interest to practitioners due to the geographical scope of the injunction, as a 'persons unknown' injunction, and as to service.

 

HS2’s legal team for the application was led by Julie Dilcock (HS2 Legal) and Rob Shaw (DLA Piper). They instructed Richard Kimblin KC, Michael Fry, Sioned Davies and Jonathan Welch.
