The High Court (Mr Justice Julian Knowles) has granted High Speed Two (HS2) Limited an interim injunction against four categories of person unknown, and several named defendants. It is a 'route wide injunction'. The injunction order as granted can be found here, and the judgment is available here.
In the wide-ranging and comprehensive judgment, the Court reviewed the implications of Barking & Dagenham, the balance of ECHR Articles 10/11 and A1P1, and the status of a hybrid public authorities such as HS2 in the context of ECHR. The judgment will be of particular interest to practitioners due to the geographical scope of the injunction, as a 'persons unknown' injunction, and as to service.
