A group of men who were violent in a Birmingham Bar and refused to help police with their enquiries have been jailed following a ‘victimless’ prosecution.
Two brothers, Robert and Thomas Cadby, went into Bar Room Bar in the Mailbox looking for Russell Broughton following a row which had been going on for years over outstanding debt. The brothers smashed a glass on Broughton’s head, and a fight broke out resulting in Robert Cadby suffering a wound running across his throat and Thomas Cadby suffering chest and facial cuts.
George Cadby, the son of Robert, and his friend Ashley Smith chased Broughton out of the bar and beat him, leaving him with serious injuries.
Despite the seriousness of the injuries suffered by all involved, no one made complaints to the authorities, so the police pushed for a ‘victimless’ prosecution.
At Birmingham Crown Court Broughton was sentenced to four years in jail after admitting wounding and possessing a knife in public.
George Cadby and Smyth were sentenced to six years in jail after admitting wounding with intent to cause GBH.
Brothers Robert and Thomas Cadby were given 15-month sentences after admitting assault.
West Midlands Police Sergeant Harjit Ubhi, said: “They clearly thought that if they refused to co-operate with police then we would be powerless to prosecute - but they were sadly wrong. In cases like this, where we have no ‘victim’ as such because no-one has complained, we can still build cases against those involved and push for prosecutions.”
