Mark Anderson QC and Yasmin Yasseri successful in ground-breaking restrictive covenant appeal

Mark Anderson QC and Yasmin Yasseri of No 5’s Commercial and Chancery team have been successful in the Court of Appeal in an important case on employer/employee restrictive covenants. In Safetynet Security Limited v Coppage, the Mercantile Court upheld a covenant which prohibited a departing director from soliciting not only existing clients but also former clients of the company, even if they had ceased being clients many years in the past. On 5th March the Court of Appeal announced that an appeal against that decision would be dismissed, with reasons to follow later. Watch this space!
