Kirsty Gallacher represents Local Authority in Walsall MBC v KK & Anor [2013]

Kirsty Gallacher represented the Local Authority in an application to transfer proceedings and 3 children, who are citizens of Slovakia, to Slovakia pursuant to the provisions of Article 15 of Brussels II revised.

The parents in this case had been trafficked to the UK in 2007. They had three children, who had lived in England since birth and had been placed in foster care.

The application to transfer the proceedings under Article 15 was made by the Centre for the International Legal Protection of Children and Youth in the Slovak Republic.

Holman J refused the application as the Slovakian court was not better placed to hear the matter, as all events had taken place in England.
