Cloak & dagger in the Court of Protection?

Fri, 09 Dec 2022

In a recent article, Dr. Laura Davidson reflected on the unusual Court of Protection case, In Re A (Covert medication: Closed Proceedings) [2022] EWCOP 44.

The case involved closed ex parte hearings which excluded one of the parties, B - represented by No5 Barristers' Chambers, Mike O’Brien KC. B was the mother of A who was subjected to covert medication for her primary ovarian failure against not only her own, but also her mother’s knowledge.

A second article by Laura will shortly be published in the same journal covering the next hearing, which will explore the proportionality and lawfulness of the closed hearings, as well as the practice of covert medication itself. In the meantime, click here to read the first article in full (with kind permission from the New Law Journal).
