Last week was a particularly busy one for Chris Bright QC as he secured total damages of £22.75 million.
On Tuesday at an RTSM leading Paul Evans as instructed by Laura Harper of Thompsons Birmingham in an above-knee amputation personal injury claim, a time-limited Claimant’s offer of £2.6m was made which was accepted on behalf of the Defendant the following day. The case was of particular interest because, unusually, the Claimant had undergone an elective amputation due to debilitating CRPS which he developed following an injury at work. Further case details will follow shortly.
On Wednesday Chris was instructed for the Claimant by Peter Savage of the Medical Accident Group at a mediation in a complex 'all or nothing' delayed diagnosis cervical myelopathy claim where permission had been given for each side to instruct no less than 12 experts on breach of duty, factual and clinical causation and quantum across four disputed scenarios with varying levels of recovery in an already orthopaedically and psychologically challenged Claimant. Following intensive negotiations, a settlement of £1m was achieved, subject, unusually, to an approval hearing requested by NHSR, notwithstanding that, at present, the Claimant is considered to have capacity. Further case details will follow post-approval.
On Friday, negotiations in a clinical negligence neonatal brain injury claim set for trial at the beginning of December in which Chris is instructed by Sarah Huntbach of Anthony Collins Solicitors finally achieved a lump sum settlement of £5.4m with a lifetime PPO of £228,000, which, given the 19-year-old Claimant’s residual life expectancy of over 60 years, amounts to a settlement £19.15m, if capitalised. Again, further case details will follow post-approval.
