Data and information rights

No5 Barristers’ Chambers is able to provide expert advice and representation in the areas of data protection and information rights.

An experienced team of barristers assist individuals, charities, companies, NHS Trusts, schools and Local Authorities in advising as to the effects of data protection law, including the UK GDPR and the Data Protection Act 2018. Training is also provided to compliance officers and other institutions. Our team’s expertise overlaps with our strengths in public law, human rights and prison law.

Expertise

  • Advising generally in respect of compliance with the new data protection regime brought about by the UK GDPR and the Data Protection Act 2018
  • Acting for both claimants and defendants in claims for breaches of the UK GDPR and the 2018 Act
  • Acting for both claimants and defendants in proceedings concerning misuse of private information and breaches of Art. 8 ECHR (the right to respect for private and family life, home and correspondence)
  • Advising in respect of requests to exercise rights under data protection law, including subject access requests, the right to rectification and the right to erasure
  • Advising in respect of personal data breaches and ICO enforcement action
  • Advising individuals as to their rights in respect of law enforcement processing by the police and prisons
  • Advising and representing claimants and respondents in relation to complaints to the OIC
  • Advising and representing claimants and respondents in relation to access to information (FOIA)
  • Advising and representing claimants seeking deletion or rectification of personal and sensitive data held by DBS and police authorities and other public authorities (including NHS, Universities)
