Nick is instructed by both claimants and defendants, with his current case load covering the full spectrum of the most serious claims, including brain and spinal cord injuries, amputations, orthopaedic polytrauma and fatal accidents, arising from road traffic accidents, employers’ and public liability claims.

Nick regularly accepts instructions in cases valued at several million pounds as sole Counsel and is often against Kings Counsel.

Nick is instructed in most cases at a very early stage where he is called upon to devise the most effective litigation strategy that will lead to a successful resolution of the claim.

Expertise

Personal Injury

Nick’s practice is exclusively in personal injury. Nick is most often instructed at the inception of a claim with a view to devising an effective litigation strategy. Nick’s style is collaborative and he works well as part of and leading the relevant legal team. Nick has a substantial paperwork practice involving most often the drafting of complex and lengthy Schedules and Counter-Schedules of Loss, with an assured prompt turnaround.

Nick is adept and working with a variety of medical and non-medical experts in order to clarify and amplify  expert evidence and fully appreciates the significance and value of compelling expert evidence in high value claims.

Round Table Meetings and all forms of ADR form a significant element of Nick’s practice, as do the full range of interlocutory and trial hearings.

Traumatic Brain Injury

Traumatic brain injury cases form a significant element of Nick’s practice with Nick at ease with claims including issues of capacity, accommodation and complex full care and rehabilitation packages.

A claim involving a company director falling down an unguarded steep bank at a golf club at a social function and suffering a traumatic brain injury.

Re DJ

A claim involving a roofing contractor who fell from a height and suffered life-changing injuries.

Re RM

A claim on behalf of a motorcyclist who suffered polytrauma including a traumatic brain injury after being struck by a motorist. Liability and quantum remain an issue in this ongoing claim.

Re JH

A claim on behalf of a visitor to a gym who suffered a subtle brain injury after being struck by a falling piece of gym equipment. The matter settled at a mediation after a round table meeting ended in deadlock.

Spinal Injury

Nick is regularly instructed in cases involving significant spinal injuries with varying levels of paralysis. Such cases invariably involve complex claims in respect of nursing, care, rehabilitation and accommodation costs.

Representative claims in respect of which Nick has received instructions in the last 18 months include :-

Re JL

A  claim involving a young pedestrian injured in a road traffic accident by a speeding motorist. Liability, contributory negligence and quantum all remain in issue. The Claimant has sustained a life changing spinal cord injury and a TBI.

Re  SM 

A claim involving a young professional injured in a road traffic accident whilst a passenger in her partner’s vehicle. A multiple vehicle collision causing the Claimant to suffer numerous significant fractures to her spine. Liability and quantum remain in issue, with the claim ongoing.

Re GB

A claim involving a young Claimant, with pre-existing behavioural challenges, who fell from height whilst undertaking voluntary work. The Claimant suffered a TBI and spinal injuries. as a consequence of which his care requirements and cognitive deficits have been significantly exacerbated. Causation and quantum remain in issue.

Notable Personal Injury Cases


University of East Anglia v Spalding (2011) EWHC 1886 (Spencer J)

This focused on the interpretation on the Personal Protective Equipment at Work Regulations 1992. Successfully represented Claimant at trial and successfully resisted appeal.


Severn Trent Hydrogen Sulphide Litigation

Nick represented multiple claimants who suffered personal injury due to prolonged exposure to hydrogen sulphide. A number of novel issues arose in relation to the issue of breach of duty.


B v F

Subtle brain injury claim for cyclist involved in road traffic accident. Multiple, complex expert input. Claim of significant value settled for damages in excess of £1,500,000.


W v M.O.J

Novel claim involving prison officer contracting T.B from prisoner. Psychiatric injuries followed development of T.B. Claimant succeeded,


E v LCL

Novel dispute in a fatal accident claim where nature of deceased’s relationship with the Claimant was in issue and where dependency denied. Claim succeeded in full.


I v S

Fatal accident claim in a factory where the accident was unwitnessed. Represented Deceased’s family at inquest and then through to joint settlement meeting, where matter settled for a very significant sum.


L v BSP

A claimant whose dominant hand was amputated in an industrial accident. Claim worth in excess of £1,000,000


W v MIB

A claimant who suffered a below knee amputation as a consequence of a road traffic accident. Claim worth in excess of £1,500,000


DA v TVGC

An occupier’s liability claim where the Claimant suffered brain injury after a fall at a golf club. Claim worth in excess of £1,000,000; and


DJ v M& M D LTD

A Work at Height claim where the Claimant suffered significant orthopaedic and head injuries and where liability remains in dispute. Value in excess of £750,000


RC v DP

A claim arising from a road traffic accident where the Claimant suffered significant bilateral leg fractures. Value in excess of £650,000
