Nathan Alleyne-Brown regularly appears in low level cases through to more complex and sensitive cases involving children both in the Public Law and Private Law spheres at County Court and High Court level including occasional appeal hearings.
Nathan represents parents, alleged perpetrators of injuries including intervenors, grandparents and wider family members, children represented through their CAFCASS Guardians and children instructing their own solicitors.
The areas of work covered include all aspects of physical, emotional and sexual abuse (including those which are the subject of medical dispute in cases where a child has suffered multiple broken bones and injuries and cases of serious physical chastisement particularly families from Afro Caribbean and African heritage).
Nathan’s experience as a criminal defence advocate has propelled him into being a robust and firm defender of human rights for adults and children.
Nathan also represents individuals in matrimonial financial remedy proceedings, ranging from small, medium and occasionally high asset value proceedings in contested proceedings following divorce.
Nathan’s practice encompasses all aspects of Family Law, including Public and Private Law Children, Divorce and Financial Remedies.
This includes: contested ICO and initial hearing, Case Management Hearings, lengthy fact-finding hearings, contested final hearings across a range of areas from low level neglect, physical and sexual harm cases to forced marriage protection order cases and deprivation of liberty cases in the High Court.
Nathan also represents parents in Family Law Act Matters (Non-Molestation and Occupation Order Applications) and Private Law Child Arrangements for Contact and/or Residence applications that frequently involve intractable hostility or serious allegations including Domestic Abuse, Coercive and Controlling behaviour raised by one parent (or the child) against another. Nathan’s particular interest is in cases that involve careful consideration of criminal evidence and material due to his criminal expertise and knowledge.
Prior to commencing Pupillage Nathan spent 3 years working in-house within Local Government Children Services department at Haringey Legal Services, assisting up to 4 fee earners on care proceedings ranging from low-level neglect to complicated Non-Accident Injuries of serious physical injuries. He was fortunate to gain valuable experience by working on the Baby P proceedings. This has meant that Nathan has key insight into Local Authority procedure having worked alongside their own in-house solicitors and social workers.
The experience above has enabled Nathan to develop an incredibly strong and consistent practice acting in Public Law matters at County and High Court levels in cases ranging from:
Neglect ranging from a lack of food to chronic neglect of severe household uncleanliness and leaving children unsupervised for large periods of the night
· Serious physical chastisement using belts and other implements as a weapon, which has also resulted in serious injury and bruising.
· Stress positions holding items in the air for extended period of times culminating in physical and emotional distress.
· Significant injuries notably non accidental burn injuries with hot implements where the child has been permanently scarred
and broken bones including skull and jaw
fractures.
· Sexual abuse by biological parents and third parties, including with implements.
· Parental alcohol/substance misuse or domestic violence/abuse during pregnancy and thereafter.
Nathan also appears in the Family Drug and Alcohol Court (FDAC) involving serious Substance misuse of alcohol and Class A Drugs.
Nathan represents mothers, fathers, and other family members in disputes regarding child custody, arrangements for where the children should live, or the time they should spend with each parent. This includes specific issues such as schooling, medical treatment, religious upbringing, or taking children abroad temporarily or permanently. Nathan also has experience in domestic and internal relocation cases which are usually contested by a parent who is concerned about their relationship with the child being impeded.
Nathan provides advice and representation on all issues relating to the care and upbringing of children arising from a family breakdown. He has gained over the years a wealth of experience in representing parties in complex and intractable disputes, including parental alienation, child abduction, and urgent cases requiring injunctions, wardship cases and those involving the inherent jurisdiction of the High Court. The enforcement of orders relating to children’s arrangements in instances where a party fails to comply with court orders, is an area that Nathan has vast experience in.
