Mirren Gidda

Mirren Gidda is a pupil barrister within No5’s Public Law group. She spent her first six months of pupillage under the supervision of Philip Rule KC and David Gardner and is now accepting instructions as part of her second six.

Mirren has a keen interest in representing claimants in the fields of police law, prisons law and asylum-related judicial reviews, as well as representing families in inquests. She is currently co-convenor of the Police Action Lawyers’ Group and chair of an independent stop and search police monitoring group.

Prior to coming to the Bar, Mirren spent nine years working as a journalist with the BBC, as a documentary presenter for Channel 4 and, most recently, as an investigative journalist with the human rights organisation, Liberty, where she spent four years setting up and working for Liberty’s first journalism unit.

Several times award-nominated, Mirren’s journalistic work led to her giving evidence to a parliamentary select committee, was cited in legal proceedings, and forced the Metropolitan Police Service to U-turn over one of its decisions. Her journalistic experience means she brings tenacity and determination to her practice, as well as empathy for her clients.

Expertise

Public Law

Mirren has experience in a wide range of claimant-focused public law matters. During her first six months of pupillage, she assisted with:

  • A successful judicial review establishing that the Secretary of State for the Home Department acted unlawfully in his treatment of pregnant and new mother asylum-seekers through a failure to discharge the Public Sector Equality Duty
  • An application for permission to appeal to the European Court of Human Rights in a technology-related public law matter
  • An application for permission to appeal to the Supreme Court in an age assessment matter
  • Drafting judicial review grounds and a subsequent reply for a case challenging the Secretary of State for Justice’s decision to keep a prisoner detained in Category A conditions
  • Drafting judicial review grounds in asylum matters, including age assessment and asylum accommodation cases

    Prison & Police Law

    As chair of an independent police monitoring group and co-convenor of the Police Action Lawyers’ Group, Mirren is particularly interested in civil claims and public law actions against police forces and prisons. She is currently instructed in a civil claim against the Ministry of Justice concerning use of force against a prisoner and has provided advice in a prospective judicial review challenge against a Parole Board’s decision not to recommend release.

    During her first six months of pupillage, Mirren assisted with several high-profile prison law judicial review challenges and provided advice on a prospective civil claim against a police force.

    Community Care

    Mirren has a particular interest in the intersection between immigration matters and public law. In her previous roles as an advocate with the children’s rights organisation Coram Voice, she assisted unaccompanied asylum-seeking children with age assessment disputes and, as a journalist with the human rights organisation Liberty, she reported on conditions in asylum accommodation.

    During her first six months of pupillage, Mirren worked on:

    • A successful judicial review challenging the Home Office’s unlawful treatment of pregnant and new mother asylum-seekers through a failure to discharge the Public Sector Equality Duty
    • Several judicial reviews challenging the Home Office’s refusal to move asylum seekers into dispersal accommodation
    • Age assessment disputes on behalf of unaccompanied asylum-seeking children

      Education

      Mirren is currently taking instructions in SEN tribunal matters. Having previously worked for the children’s rights organisation Coram Voice, she is particularly interested in helping represent families at the tribunal.

      Inquests, Public Inquiries & Coronial Law (Public Law)

      Mirren has a keen interest in representing families at inquests. She is currently representing two sisters whose mother died whilst sectioned in a psychiatric hospital. She also recently represented bereaved parents during an inquest into the deaths of their two babies.

      During her first six months of pupillage, Mirren assisted with an inquest into the death of an IPP prisoner, who died by suicide after being notified of his recall to prison. She also helped advise a bereaved family as to whether they could bring a judicial review challenge to a coroner’s decision.

      Mirren also assisted her supervisor, David C. Gardner, in his representation of the Children’s Commissioner for Wales at the COVID-19 inquiry.

      Court of Protection

      Mirren is currently taking instructions in Court of Protection cases and has been instructed in several matters on behalf of the Official Solicitor. She is particularly interested in health and welfare cases on behalf of the protected party.
