Mamta is a leading senior junior in the fields of clinical negligence and personal injury litigation.  She specialises in cases involving serious injury of significant value and complex cases.

Aside from being a very effective advocate at Court. Mamta is an accomplished negotiator with an established track record of advising on evidence and strategy and guiding the cases she is instructed on to achieving the best results possible via ADR.  She is dedicated to working as part of the legal team alongside her instructing solicitors and delivering a first-class service whilst making a difference for her clients.  Mamta is very hardworking, easy to work with, responsive and is known for her forensic attention to detail.  Mamta is often instructed in the most sensitive cases and is known for her empathetic and considerate approach with clients.

Clinical Negligence

Mamta specialises in clinical negligence litigation, with an established practice spanning the full spectrum of medical fields.

She is regularly instructed in complex and high value cases, [in excess of £1m] where medical accidents have resulted in the most catastrophic injuries.  Having a degree in Pharmacology is a bonus, Mamta is adept at getting to grips with medical principles and concepts quicky and is at ease when dealing with experts. Mamta has lots of experience in fatal cases as well as cases involving protected parties, minors and those without capacity.

Mamta has widespread experience in brain injury, birth injury, spinal injury and amputation cases.  In addition, Mamta has particular experience in mental health/suicide cases and how to navigate the quirks these particular fatal cases present.

Mamta also has particular experience of wrongful birth cases and the challenges and quirks that can arise.  In particular, Mamta has worked on cases where the child was born with Downs or Jacobsen Syndrome.

Mamta also has marked experience in cases involving birth trauma, from severe maternal injury to shoulder dystocia and stillbirth.

In addition, Mamta has widespread experience of working on gynaecological cases, general surgical cases and orthopaedic cases.

Mamta has recently represented a Claimant who has suffered injury and loss from the negligence of two consecutive tortfeasors, the first for occupiers’ liability and the second for clinical negligence. Mamta has a detailed knowledge of the law/authorities in this area and the arguments and issues that can arise.

Mamta also represents parties at Inquests including those incorporating Article 2 and Juries.

Orthopaedic/Amputation

Mamta is regularly instructed in cases involving Claimants who have had or require amputation. She has widespread experience dealing with the full range of orthopaedic injuries due to mismanagement in A&E to surgical team negligence.

Recent cases include:

  • Failure to identify malignant pathology on x-ray causing full leg amputation
  • Failure by GP to refer, notwithstanding advanced diabetic foot infection leading to avoidable amputations and increased risk of future amputations plus permanent injury [settled for £800K, full and final]
  • Failure by hospital to appropriate treat diabetic infection leading to double lower limb amputation;
  • Negligent total knee replacement surgery resulting in foot drop/permanent injury

Brain Injury & Cerebral Palsy

Recent cases include:

  • Delay in diagnosis of extra dural haematoma following unwitnessed fall in hospital leading to traumatic brain injury permanent disability and 24-hour care.
  • Failure to carry out MRI/investigations in light of facial numbness and headache symptoms leading to avoidable stroke in young woman;
  • Failure to identify low sodium levels resulting in central pontine myelinolysis leading to catastrophic injury [settled for £2.6m, with Leading Counsel]
  • Failure to test mother’s urine for infection antenatally leading to the child suffering acquired brain injury and profound bilateral deafness [settled for £8m with Leading Counsel]
  • Failures in obstetric/midwifery care leading to child suffering cerebral palsy and death;

Oncology

  • Failure to identify DCIS/pre-invasive breast cancer resulting in death, extensive loss of services claim, for 8 dependents. [settled for £650K [lump sum] + PPO]
  • Delay in diagnosis of larynx cancer leading to laryngectomy [loss of voice box]
  • Failure to diagnose lung cancer by delaying in referral for imaging causing death
  • Delay in treating ovarian cancer
  • Failures in treating prostate cancer

Gynaecology & Obstetrics

Mamta is regularly instructed in cases involving mismanagement of pregnancy and birth, including the tragedies of stillbirths and neonatal deaths; and mismanagement of gynaecological and women’s health conditions.

Recent cases include:

  • Wrongful birth case – failure to carry out antenatal screening for chromosomal abnormalities/missed opportunity to have termination causing birth of child with Down’s Syndrome [settled for £6m +PPO with Leading Counsel]
  • Wrongful birth case – failure to advise on need for amniocentesis/deprived Claimant of having termination causing birth of child with Jacobsen syndrome;
  • Failure to offer caesarean section leading to physical injury of mother and child
  • Failure to recognise pathological CTG resulting in stillbirth
  • Substandard caesarean section surgery causing permanent damage to bladder, urethra and vagina
  • Failures associated with TVT/TOT [inc. consent issues]
  • Failures to identify bladder perforations during gynaecological surgery resulting in permanent injury
  • Obstetric failure to act upon pathological CTG leading to shoulder dystocia/Erbs Palsy [in this case the labour records had been lost and therefore difficult to prove negligence]
  • Mismanagement of shoulder dystocia leading to acute profound hypoxia ischaemia
  • Death of young women during medical termination surgery, survived by 5 children. [also representing the family at the 10-day inquest]
  • Obstetric failures leading to fourth degree perineal tears and faecal incontinence/chronic pain
  • Substandard hysterectomy surgery causing bilateral ureteric damage, need for nephrostomy/nephrectomy

Medical / Surgical

Mamta acts in the full manner of claims including delays in diagnosis, mismanagement of medical conditions and injuries and negligently performed surgery.

Recent cases include:

  • Failure to treat methotrexate toxicity resulting in pancytopenia, sepsis and eventual death
  • Failures in cosmetic surgeries including rhinoplasty and breast augmentation/reconstruction;
  • Negligent Brazilian butt-lift surgery; [application to rely upon similar fact evidence successfully opposed]
  • Failure of NHS Trust to adequately treat Claimant who was involved in serious RTA, Deceased stuck in his car for hours and ultimately bled to death [settled for £550K]
  • Pressure sore and sepsis cases;
  • Negligence of respite home causing fall and injury of disabled child;

Mental Health

Mamta has represented spouses and parents in a number of fatal suicide cases and has widespread experience in dealing with the quirks these cases can present, how the mental health system works and the legal points that can be raised in such cases. Mamta is often instructed at the start of such cases, representing the families at inquest.

Recent cases include:

  • Psychotherapist negligence causing suicide by hanging [involving dependency claim based on couple running the business]
  • Trust negligence causing suicide by hanging in hospital discharge lounge.
  • Negligent care of Crisis/HTT teams causing suicide by hanging
  • Negligent care of Community Mental Health Team causing suicide of patient with psychosis [settled at £245k].

Spinal Injury

  • Delay in diagnosis of cauda equina
  • Negligently conducted surgery causing permanent injury/paraplegia

Mamta has carried out a large number of inquests in her practice to date including those engaging Article 2 and also those involving juries.

Personal Injury

Mamta has widespread experience in the field of personal injury litigation. She is regularly instructed in complex and high value cases, [in excess of £1m] involving Claimants who have suffered the most catastrophic injuries.

Her practice has encompassed all manner of accidents including road traffic accidents, industrial accidents and occupiers’ liability.

In particular Mamta has worked on cases involving polytrauma and the most serious orthopaedic injuries requiring amputation or provisional damage claims for amputation.

Mamta’s caseload has also included complex future loss of earnings claims for NHS workers and police officers.

Mamta was instructed as part of the legal team acting on behalf of one of the Defendants in the Grenfell Alternative Dispute Resolution overseen by Lord Neuberger.

Mamta has recently represented a Claimant who has suffered injury and loss from the negligence of two consecutive tortfeasors, the first for occupiers’ liability and the second for clinical negligence. In 2022, Mamta was instructed as part of the legal team acting on behalf of one of the Defendants in the Grenfell, Alternative Dispute Resolution overseen by Lord Neuberger.

Recent cases include:

  • RTA where Claimant suffered crushing injury to lower body when hit by car as a pedestrian. She suffered polytrauma and the need for further amputations.  Claim for PD made. [settled for £2.5m in full and final settlement].
  • RTA where Claimant pedestrian was hit by car and pushed through window suffering catastrophic and lifelong injuries including future amputations.
  • RTA where Claimant suffered serious orthopaedic injury; successful claim for loss of chance of career in police force [settled at £350K]
  • Failure by TV studio to provide proper instructions/warnings in studio leading to slip and trip accident, causing serious injury;
  • RTA where Claimant was passenger in bus, ejected from window during collision and suffered catastrophic injury;
  • RTA where Claimant suffered severe polytrauma after being hit and dragged by car; C suffered pulmonary embolism and severe maxillofacial injuries;
  • EL case where C suffered severe open right forefoot trauma involving traumatic amputations of the toes and right forefoot, when lifting a load at work.
  • RTA where the Deceased’s motorcycle was hit resulting in death. Claim made for loss of income dependency on basis of couple running business at the time of death.
