Clinical Negligence
Jodie has a varied and busy Clinical Negligence practice. Her experience ranges from injury arisin gynaecological and obstetric errors, delayed or missed diagnosis, oncological matters and failed surgical procedures. Jodie predominantly undertakes Multi Track work and has a depth of experience advising in matters involving serious, multiple and complex injuries, including brain and spinal injuries. Her early desire to specialise in this area of law means that she is highly experienced in conducting conferences with medical professionals of all specialties and recognises the interplay and overlap between them.
Jodie is adaptable and personable and extremely capable of assisting clients through the litigation process with quiet confidence, which frequently results in her being engaged at the very early stages of a case. This often includes representing parties at inquests, which she has considerable experience in doing. Jodie also has a keen interest in Fatal Accidents Act matters and can knowledgeably advise on complex matters of dependency and quantum.
Jodie is frequently led by senior members of Chambers. She regularly appears in the County and High Court in these cases as well as her own, making her an experienced and confident advocate. She is also experienced in the usual methods of ADR.
Notable Clinical Negligence Cases
EK v BCULHB
Jodie acted for the Claimant who suffered negligent urogynaecological treatment resulting in uncontrolled pain affecting lower limb mobility requiring pain management and assistance with all daily activities; permanent difficulties with incontinence; and, psychological injury. Jodie represented the Claimant at a Joint Settlement Meeting and secured settlement in excess of £200,000.
JH v TMOD
Acting on behalf of the Defendant, Jodie advised regarding the admitted misdiagnosis of a haematological disorder resulting in unnecessary treatment and the development of a psychological disorder. Jodie drafted pleadings before negotiating a favourable settlement at JSM.
PV v EKUHNHSFT
Jodie was instructed on behalf of the Claimant regarding the delayed diagnosis of a lung lesion causing long term chronic joint damage and requiring ongoing medication. The matter concluded at JSM.
JM v TMOD
Acting on behalf of the Defendant, Jodie advised regarding the admitted misdiagnosis of a haematological disorder resulting in unnecessary treatment and the development of a psychological disorder. Jodie advised and drafted pleadings ahead of a JSM, before negotiating a favourable six-figure settlement.
