Jodie Kembery has a successful and diverse Clinical Negligence and Personal Injury practice, having specialised in these areas since commencing her career.

Within her Clinical Negligence Practice she frequently advises in cases involving gynaecological and obstetric issues, delayed or mis-diagnosis, oncological matters and failed surgical procedures. In Personal Injury, Jodie has a wealth of experience regarding injuries sustained in road traffic accidents and accidents at work and in public places. She enjoys engaging with cases and clients in early stages of the life of a claim so as to help guide the matter to a successful conclusion.

Jodie is very experienced in conducting conferences with lay and professional clients and experts on complex issues of liability and quantum, often in emotional circumstances. Jodie’s excellent interpersonal skills and professionalism allow her to be thorough and robust in her examination of the issues in question, whilst remaining sensitive of the clients’ needs.

She has a thriving paperwork practice and regularly prepares all manner of pleadings and written advice. She has a real ability to succinctly distil complex legal and medical concepts, often with difficult advice, in a helpful way. Written work or advice can often at short notice when required.

Jodie is instructed by both claimants and defendants. She was appointed to the Attorney General’s Civil Regional C Panel in 2020 and regularly acts for government departments to provide advice, pleadings and representation at hearings. Her experience ranges from injury arisin gynaecological and obstetric errors, delayed or missed diagnosis, oncological matters and failed surgical procedures. Jodie predominantly undertakes Multi Track work and has a depth of experience advising in matters involving serious, multiple and complex injuries, including brain and spinal injuries. Her early desire to specialise in this area of law means that she is highly experienced in conducting conferences with medical professionals of all specialties and recognises the interplay and overlap between them.

Jodie is adaptable and personable and extremely capable of assisting clients through the litigation process with quiet confidence, which frequently results in her being engaged at the very early stages of a case. This often includes representing parties at inquests, which she has considerable experience in doing. Jodie also has a keen interest in Fatal Accidents Act matters and can knowledgeably advise on complex matters of dependency and quantum.

Jodie is frequently led by senior members of Chambers. She regularly appears in the County and High Court in these cases as well as her own, making her an experienced and confident advocate. She is also experienced in the usual methods of ADR.

EK v BCULHB

Jodie acted for the Claimant who suffered negligent urogynaecological treatment resulting in uncontrolled pain affecting lower limb mobility requiring pain management and assistance with all daily activities; permanent difficulties with incontinence; and, psychological injury. Jodie represented the Claimant at a Joint Settlement Meeting and secured settlement in excess of £200,000.


JH v TMOD

Acting on behalf of the Defendant, Jodie advised regarding the admitted misdiagnosis of a haematological disorder resulting in unnecessary treatment and the development of a psychological disorder. Jodie drafted pleadings before negotiating a favourable settlement at JSM.


PV v EKUHNHSFT

Jodie was instructed on behalf of the Claimant regarding the delayed diagnosis of a lung lesion causing long term chronic joint damage and requiring ongoing medication. The matter concluded at JSM.


JM v TMOD

Acting on behalf of the Defendant, Jodie advised regarding the admitted misdiagnosis of a haematological disorder resulting in unnecessary treatment and the development of a psychological disorder. Jodie advised and drafted pleadings ahead of a JSM, before negotiating a favourable six-figure settlement.

Notable Personal Injury Cases


AK v RJ

Jodie was instructed on behalf of the Claimant who suffered life-changing injuries following a motorcycle accident. Jodie developed a good rapport and relationship of trust with the Claimant, advised throughout the claim and guided the matter to settlement in the sum of £1.35million.


AEA v CS

as junior counsel, Jodie was very closely involved throughout the life on a claim arising from a liability-disputed road traffic accident in which the teenage Claimant suffered a life-changing traumatic brain injury. Jodie provided thorough written advice, conducted conferences independently and drafted pleadings before assisting in negotiating a seven-figure settlement.


MV v HMRC

Instructed on behalf of the Defendant regarding a claim following the development of mesothelioma. Jodie advised in the matter pre-issue and negotiated the matter to settlement.


JM v TMOD

Jodie was instructed on behalf of the Defendant. The Claimant suffered injury following an accident at work. The matter was concluded at JSM.


Inquests, Public Inquiries & Coronial Law

Jodie has significant experience in a range of inquests following the death of an individual in a road traffic accident, accident at work or other Personal Injury matter. She is experienced in dealing with Article 2 inquests and those heard before a jury and has represented families following deaths of minors and adults.

Jodie is very capable of putting a family at ease during such distressing proceedings as well as clearly explaining the limitations of the coronial process. She also frequently representing other Interested Persons, particularly government bodies. Her established personal injury practice enables her to navigate medical evidence, which is often complex, with ease. Jodie frequently continues to represent parties in the civil proceedings that follow.
