Jake Acock is a member of the Business & Property group at No.5 Chambers, specialising in chancery, property and commercial work. Jake is frequently instructed on matters beyond his level of call.

Jake has developed a busy practice in the High Court and County Court in a variety of trials and hearings. Jake is experienced to act in all stages of a claim and has experience in dealing with high value matters. Jake has a busy practice drafting pleadings and providing written advice, often in complex cases. Jake has appellate experience in both the County and High Court, and recently drafted grounds of appeal for the Court of Appeal.

Before coming to the Bar, Jake worked as a lecturer and tutor at both University College London and the London School of Economics in contract and tort law. At LSE, Jake was recognised for his outstanding teaching by the Dean of the Law School, with all of Jake’s students rating his teaching as excellent. Jake regularly gives lectures and training for clients and solicitor firms.

Jake was awarded scholarships by Gray’s Inn for both the GDL and Bar Course. Jake earned the highest grade in his year for tort law on the GDL and ranked among the top ten students for contract law. In his Bar studies, Jake earned the highest grade for civil advocacy in his year.

Jake also believes in helping pro bono causes. This year, Jake is recognised on the pro bono list for England and Wales for volunteering over 100 hours to pro bono causes, including Advocate (the Bar’s national pro bono charity).

In his spare time Jake enjoys baking and travelling, and frequently finds himself doing escape rooms.

 

Expertise

Business & Property

Jake is developing a specialist business & property practice with experience in both the High Court and County Court. Jake is often instructed on complex matters combining contract, property and trust law, whether as sole counsel or as part of a led team. Outside of court, Jake provides advice conferences, drafts statements of case and provides written advice. Jake is regularly instructed on matters beyond his level of call.

Recent and ongoing matters include:

  • Acting as sole counsel in a Trusts of Land and Appointment of Trustees Act 1996 (TOLATA) case concerning equitable accounting, constructive trusts and proprietary estoppel
  • A claim of trespass following expiry of a S.25 Notice under the Landlord & Tenant Act 1954
  • A case in fraudulent misrepresentation valued at more than £1 million
  • Acting in interim and final hearings relating to relief pursuant to TOLATA and drafting proceedings for the same
  • An easement dispute over a parking space, applying the law following Moncrieff v Jamieson [2007] UKHL 42
  • A mediation arising out of breach of contract involving a national haulage and logistics company
  • A boundary dispute involving private nuisance, trespass and adverse possession
  • Drafting grounds of appeal in a Court of Appeal case concerning equitable accounting and challenging the case law of Ali v Khatib [2022] EWCA Civ 481
  • A case involving the law around burial plots and trespass in the High Court, seeking injunctive relief

Real Estate

Jake is developing a strong practice in Real Estate litigation and is frequently instructed on property matters in both the County and High Court.

Jake practises in all areas of property law, from possession claims to multi-track trials involving complex areas of law. Jake has experience in commercial landlord and tenant matters (including claims under the Landlord & Tenant Act 1954), dilapidation matters, easement disputes, breach of covenant, contractual interpretation of leases, boundary disputes, and equitable remedies such as specific performance, rectification or rescission. Jake also deals with residential landlord & tenant matters.

Recent instructions include:

  • A fast-track trial on trespass and proprietary estoppel
  • Successfully securing a charging order over a property by defeating the Defendant’s claim there was a valid trust in place
  • Successfully recovering a property by establishing deceit, undue influence and TOLATA matters in a multi-track trial
  • An appeal to the High Court involving service charges and contractual interpretation of a lease
  • Advising on a parking easement, applying the law of Moncrieff v Jamieson [2007] UKHL 42
  • Advising on a claim involving private nuisance and Protection from Harassment Act 1997
  • Drafting pleadings in a boundary dispute and adverse possession
  • Drafting pleadings and providing written advices in TOLATA matters

Commercial Litigation

Jake has a broad practice in commercial litigation and is frequently instructed on matters involving breach of contract, formation of a contract, mistake, and equitable remedies such as specific performance, recession, rectification and equitable damages. Jake also represents clients in cases involving misrepresentation, frustration and contractual interpretation.

Jake draws on his experience from lecturing in contract law at LSE, which clients find is valuable to all cases he is instructed on. Jake has been described as bringing a very practical approach to commercial matters and is therefore instructed on giving advice in complex commercial cases, both in writing and in conference.

Jake’s recent work includes:

  • Representing a client accused of fraudulent misrepresentation in a case valued at £1 million
  • Seeking to set aside a statutory demand for over £2 million
  • Advising and drafting statements of case in a breach of contract claim for a national logistics company
  • Appearing as sole counsel in the High Court in a rectification matter
  • Advising on the interpretation of a dispute resolution clause in an options agreement for purchase of land valued at over £5 million
  • Cases involving breaches of implied terms from the Consumer Rights Act 2015
  • Advising and drafting statements of case in a case concerning penalty clauses

Jake is well-equipped to help with any commercial or contractual matter. He has a particular focus on breach of contract, contractual interpretation of clauses, and misrepresentation. Jake is often instructed on complex cases where there is a combining trust, contract and property matters.

Technology & Construction

Jake is beginning to build a practice incorporating construction disputes, in particular construction disputes involving contractual issues and misrepresentation. Jake’s latest work in this area includes providing advice on breach of contract for a housing renovation and drafting a Defence for breach of contract.

Trusts And Inheritance Act Disputes

Jake has expertise in trust matters and is frequently instructed on Inheritance Act disputes arising from claims under the Inheritance (Provision for Family and Dependants) Act 1975, claims of proprietary estoppel, and claims to substitute or remove executors and trustees.

Jake’s recent work includes:

  • Drafting grounds of appeal in a Court of Appeal case involving equitable accounting and TOLATA matters, challenging the case law of Ali v Khatib [2022] EWCA Civ 481
  • Successfully representing a Defendant who lacked capacity in a claim for financial provision under the Inheritance (Provision for Family and Dependants) Act 1975
  • Successfully securing a charging order over a property by defeating the Defendant’s claim there was a valid trust in place
  • Drafting statements of case in an undue influence and proprietary estoppel claim
  • Acting in interim and final hearings relating to relief pursuant to TOLATA and drafting proceedings for the same
  • Advising on the administration of an estate in circumstances where there are third-party claims against the estate, including issues of alleged lack of testamentary capacity and fraudulent claims
  • Advising and representing clients for the removal of executors/trustees of estates
  • Advising in claims for proprietary estoppel and constructive trusts

Defamation And Malicious Falsehood

Jake is developing a strong practice involving claims involving defamation, malicious falsehood, breach of confidentiality, harassment, and misuse of private information.

Jake lectured on the law of defamation at UCL and regularly provides tutorials in universities and to clients on the law of defamation.

Jake’s recent work includes:

  • Advising and drafting documents in a claim for malicious falsehood with damages valued over £100,000
  • Securing an injunction for threatened breach of confidentiality after an employee attempted to leak trade secrets
  • Advising, drafting statements of case, and representing clients in claims for defamation and malicious falsehood in the Media and Communications List in the High Court
  • Successfully representing a local council in defending a GDPR claim under the Data Protection Act 2018
