Howard Leithead is a specialist planning and environmental law barrister. He acts for and advises clients of all types, including developers, local authorities, Secretaries of State, campaign groups, local residents, and private individuals.

An accomplished advocate, Howard regularly appears in inquiries and hearings and represents clients in cases in courts and tribunals from the magistrates’ court to the Court of Appeal. He is experienced in dealing with complex areas of the law and is known for providing comprehensive and practical advice.

Howard accepts instructions both from professional clients and on a public access basis across England and Wales. He is appointed to the Attorney General’s C Panel of Counsel in London, which enables him to advise and represent the Government, usually in the High Court.

Howard regularly writes articles and speaks about planning and environmental issues. He produces expert analysis articles, appears on No5 Planning Podcasts, participates in webinars, and gives papers at seminars and conferences.

He is committed to education and training and is involved in training professional witnesses for planning inquiries, coaching and mentoring students, and judging competitions.

Expertise

Planning

Howard has developed a specialism in planning over more than a decade. Much of his practice is focused on helping clients to obtain or oppose grants of planning permission. He advises at the planning application stage and regularly represents clients at public inquiries throughout England and Wales as well as in challenges in the High Court and the Court of Appeal (see below).

In addition, he deals with a range of other planning matters, such as lawful development certificates, the interpretation of planning permissions and s.106 agreements, and the applicability of permitted development rights.

Howard further maintains a busy enforcement practice. He advises and represents both local planning authorities and those against whom enforcement action is being taken, both in appeals against enforcement notices and in court proceedings.

Howard is effective at working with teams of expert witnesses and is highly skilled in cross examining witnesses.

Residential

Howard has particular experience in advising and representing those promoting and opposing residential development. He has advises and represents developers, local authorities, and interested parties at all stages of the application process.

He is experienced in all the main topic areas for which expert evidence is required, including Green Belt, housing land supply, heritage, highways, daylight and sunlight, flood risk, ecology, viability, accessibility, air quality, noise, light, and biodiversity net gain.

Renewable Energy

There has been a significant increase in applications for renewable energy developments, particularly solar farms and battery energy storage systems. Howard is experienced in advising and representing those promoting and opposing such developments.

Many of the topic areas that arise are the same as those for other forms of development such as Green Belt, landscape, heritage, flood risk, and highways. Howard is experienced in dealing with those and has developed further experience in dealing with the issues that are more particular to renewable development, such as the need for such developments.

Other development

Howard is regularly instructed to advise and act for clients in matters concerning other forms of development, including to appeal.

These have included proposals for: gypsy and traveller sites, residential care, minerals and waste developments, employment and logistics developments, a major new prison, and a hotel.

He has further been instructed in compulsory purchase disputes.

Highways

Howard is experienced in dealing with highways issues both within planning appeals and in separate disputes.

He has advised and acted for highway authorities, local planning authorities, and others in a range of contexts and has appeared in magistrates’ courts court, the Crown Court, and the High Court in highways disputes.

Footpaths and rights of way

Howard is instructed on matters involving footpaths and rights of way.

He has represented clients in matters involving interference with a right of way, the stopping up of a footpath under s.257 and a challenge to the decision of the local planning authority to add a footpath to the Definitive Map and Statement.

Planning Appeals

Howard has successfully represented clients in inquiries and hearings in a covering a range of areas including residential development, solar energy (including battery energy storage systems), and gypsy and traveller sites.

Beyond development, Howard has represented clients in appeals concerning footpaths and rights of way.

  • Land at Tournerbury Woods, Tournerbury Lane, Hayling Island PO11 9DL (APP/X1735/X/21/3278706, appeal withdrawn January 2026), represented Chichester Harbour Conservancy, a Rule 6 Party, in an appeal against the local planning authority’s refusal of a lawful development certificate.
  • Land at Site A and Site B, Redhill Railway Station, Princess Way and Redstone Hill, Redhill RH1 1QA (APP/L3625/W/25/3364217, 19 January 2026), represented Redhill Residents Action Group (RRAG), the Rule 6 Party, in an inquiry concerning the proposed development of up to 225 dwellings in two buildings ranging from 10-15 storeys and 7-14 storeys.
  • Land east of Houghton on the Hill, Leicestershire (APP/F2415/W/25/3369369, appeal withdrawn January 2026), represented the local planning authority in an inquiry involving the proposed development of up to 230 dwellings, a residential care home, a GP surgery and retail provision.
  • Land adjacent to Sotby Woods, Sturton Road, Hatton, Lincolnshire (APP/D2510/W/25/3363157, 12 December 2025), led by Richard Kimblin KC, represented the developer in an inquiry concerning the proposed development of a 49.9.MW solar farm.
  • Land 800 Metres South of Park House Farm, Meriden Road, Fillongley (APP/R3705/W/24/3349391, 11 December 2025), represented the local planning authority in an inquiry that involved the proposed construction of a temporary 49.9MW solar far.
  • Land off M1- A45 Roundabout Junction 16, Upper Heyford NN7 3NF (APP/W2845/W/24/3354897, 26 August 2025), represented Nether Heyford Parish Council, in a hearing regarding the proposed extraction of sand and gravel with the deposition of suitable inert material.
  • Land East of Froghall Road, Cheadle, Staffordshire (APP/B3438/W/24/3351035, 26 March 2025), represented the local planning authority in an inquiry concerning the proposed development of c.210 dwellings.
  • Land at Orchard Farm, North of Defford Road, Pershore (APP/H1840/W/24/3347643, 29 January 2025), represented the local planning authority in an inquiry involving the proposed development of up to 300 dwellings on a site adjacent to ancient woodland.
  • Land at 1-5 Hillside, Portsmouth Road, Esher, Surrey, KT10 9LH (APP/K3605/W/24/3350737, 24 January 2025), represented the local planning authority in an inquiry involving the proposed development of 38 retirement homes in the Green Belt.
  • Land at Mucknell Farm Lane, Stoulton (APP/H1840/W/24/3345106, appeal withdrawn January 2025), represented Homes England, a Rule 6 Party, in an appeal concerning the proposed development of a solar farm.
  • Land North of Biggleswade, Biggleswade, SG18 0HB (APP/P0240/W/24/33407776, 6 November 2024), represented the Town Council Rule 6 Party in inquiry involving the proposed development of up to 416 dwellings.
  • Land north-east of Junction 10 of the M42 Motorway, Dordon, North Warwickshire (APP/R3705/W/24/3336295, 5 August 2024), represented the local Rule 6 Party in an inquiry concerned with a proposed major industrial development in a strategic gap.
  • Land at Staythorpe, Newark, NG23 5RG Grid Ref 475454 353713 (APP/B3030/W/23/3334043, 3 May 2024), represented the local planning authority in an inquiry defending its refusal of planning permission for the development of a battery energy storage system (BESS).
  • Land off Haywood Way, The Close, Cleeve Prior, Worcestershire WR11 8LF (APP/H1840/W/23/3317390, 13 December 2023), represented a parish council in a hearing concerning the proposed change of use of the site to use as a residential caravan site for gypsy families.
  • Land adjacent to HMP Gartree, Welland Avenue, Gartree, Market Harborough, Leicestershire LE16 7RP (APP/F2415/W/22/3300227, 15 November 2023), represented the local planning authority in an inquiry involving the proposed development of a new national Category B prison of up to 82,555 m2 in an inquiry to determine an appeal called in by the Secretary of State.
  • Land off Barkby Road, Queniborough, Leicestershire LE7 3FB (APP/X2140/W/23/3316574, 9 November 2023), represented the local planning authority in an inquiry concerning the proposed development of 150 dwellings.
  • Land at Buckingham Hotel, 1-2 Burlington Road, Buxton, Derbyshire SK17 9AS (APP/H1033/W/22/3302879, 15 August 2023), represented the local planning authority in a hearing concerning a proposal to demolish and rebuild a historic hotel.
  • Land at (OS 8579 4905) Post Office Lane, Kempsey, Worcestershire (APP/J1860/W/22/3313440, 14 August 2023), represented the local planning authority in an inquiry involving the proposed development of 30 dwellings.
  • Land at Loughborough Road, Burton on the Wolds, Leicestershire (APP/X2410/W/22/3310932, 26 July 2023), represented the local planning authority in a hearing concerning a proposal to develop of 56 dwellings.
  • Land at Broadway Lane, Fladbury, Pershore, Worcestershire WR10 2QF (APP/H1840/W/22/3313745, 22 June 2023), represented the local planning authority in a hearing involving a proposal to develop 34 affordable dwellings.
  • Land off Leconfield Road, Nanpantan (APP/X2410/W/22/3304644, 5 May 2023), represented the local planning authority in an inquiry concerning the proposed development of up to 30 dwellings.
  • Land at 8-10 Station Road, Shirehampton, Bristol BS11 9TT (APP/Z0116/W/22/3305852, 5 April 2023), represented the developer in a hearing involving the proposed development of 21 dwellings.
  • Land North of Barking Road, Needham Market IP6 8EZ (APP/W3520/W/22/3308189, 31 March 2023), represented the developer in an inquiry involving a proposal for up to 279 dwellings.
  • Tree Tops, School Lane, Coven, Staffordshire WV9 5AN (APP/C3430/W/23/3331128, 15 March 2023), instructed by the developer on a written representations appeal concerned with whether a proposal constituted limited infill in a village in the Green Belt and therefore appropriate development.

Planning Judicial and Statutory Reviews

Howard advises on and represents a wide range of clients in judicial reviews and statutory reviews under s.288. These include the Secretary of State as a member of the Attorney General’s C Panel of Counsel in London.

Recent cases include:

  • Chase New Homes Ltd v Secretary of State for Housing, Communities and Local Government (High Court, 2025), represented the Secretary of State in a s.288 challenge of an inspector’s decision to refuse approval an application for reserved matters under s.62A.
  • R (Save Smallbrook) v Birmingham CC [2024] EWHC 2535 (Admin), represented the local planning authority in a challenge to the decision of the Secretary of State on appeal to grant planning permission for a residential development.
  • Mid Suffolk District Council v Secretary of State for Levelling Up, Housing and Communities (High Court, 2024), represented the Interested Party developer in a s.288 challenge to the Secretary of State’s decision to grant planning permission for housing on appeal.
  • Coventry City Council v Secretary of State for Levelling Up, Housing and Communities (High Court, 2024), represented the Secretary of State in a challenge to a costs decision.
  • R (Whitley Parish Council) v North Yorkshire County Council [2023] EWCA Civ 92, led by Richard Kimblin KC, represented the Claimant in the Court of Appeal in its judicial review challenge of a decision to grant planning permission to a developer to extract pulverised fuel ash.

Planning Enforcement

Howard maintains a busy enforcement practice acting for local planning authorities and developers in appeals and court proceedings. He is highly skilled at dealing with the often-complex legal issues that arise in this area.

Planning Enforcement Appeals

Howard acts for developers, local planning authorities, and other clients in appeals to the Secretary of State against enforcement notices under s.174 and appeals against decisions to refuse lawful development certificates under s.195.

Recent appeals include:

  • Land lying to the south-west of Tilthams Corner Road, Godalming (APP/Y3615/C/25/3374326 and APP/Y3615/C/25/3374395, decision pending), represented local residents in a hearing to determine conjoined appeals against an enforcement notice that alleged material change of use to residential use as a result of citing of caravans etc, where the Appellants were members of the gypsy and traveller community.
  • Land at 83-85 Tower Hill, Perton Lane, Checkley, Hereford HR1 4NB (APP/W1850/C/23/3336085 and 86, 2 July 2024), represented the LPA in an inquiry concerning an enforcement notice which alleged material change of use of a site to a caravan site, where the Appellants sought to live off-grid.
  • Land at Little Blackthorn Stables, Road from Haye Down to Sportsmans Cross, Haye Down, Devon PL19 0NN (APP/Q1153/C/22/3313872 and 73, appeal withdrawn after withdrawal of enforcement notice 2023), represented the developers in an appeal against an enforcement notice concerned with an alleged material change of use of a building to a mixed use including residential use.
  • Land at Graddfa Industrial Estate, Colliery Road, Llanbradach, Caerphilly, CF83 3 QS (CAS-01852-Y1C3K9 and CAS-01884-X4P5V8, 17 January 2024), represented the local planning authority in conjoined appeals against an enforcement notice and against the authority’s decision to refuse to grant a lawful development certificate in relation to the development of a large industrial site.
  • Land at Brindwood House, Millthorpe Lane, Holmesfield, Derbyshire (APP/R1038/C/21/3288613 and 771, 4 January 2023), represented the local planning authority in conjoined appeals against enforcement notices involving development in the Green Belt.

Court Work

Howard represents developers, local authorities, and other clients in courts from the magistrates’ court to the High Court and the Court of Appeal. His work divides broadly into (a) civil cases, such as s.289 appeals, applications for injunctions under s.178B (often concerning gypsy and traveller sites), contempt proceedings, and appeals against s.215 notices, and (b) criminal prosecutions in the magistrates’ court and the Crown Court.

Recent cases include:

  • North Warwickshire Borough Council v Torrens et al (2) (High Court, 2026) represented the local planning authority in an application for an injunction concerning an apprehended change of use of the site to a caravan site.
  • Stratford-on-Avon District Council v Parmar (Magistrates’ Court, ongoing), represented the local planning authority in a prosecution for the alleged alteration of a Grade II listed building without obtaining listed building consent.
  • Bromsgrove District Council v Southside Properties (Midlands) Ltd (County Court, ongoing), represented the local planning authority in its application for an injunction under s.187B to restrain the development of a site in the Green Belt for industrial and commercial purposes and is now representing it in relation to costs.
  • Quarry Mews Ltd v Secretary of State for Housing, Communities and Local Government [2025] EWHC 1968 (Admin), represented the Secretary of State in the High Court and in responding to the Appellant’s unsuccessful application to the Court of Appeal for permission to appeal.
  • North Warwickshire Borough Council v Torrens et al (1) (High Court, 2025), represented the Council in an application for an injunction concerning existing and apprehended breaches of planning control related to use as caravan sites.
  • South Kesteven District Council v Smith (Magistrates’ Court, 2025), represented the Defendant, a member of the gypsy and traveller community, in a prosecution under s.179 for alleged failure to comply with an enforcement notice concerning a caravan site.
  • North Warwickshire Borough Council v McGinley (High Court, 2024), represented the local planning authority in application for a without notice interim injunction.
  • Stuart Partners Ltd v Secretary of State for Levelling Up, Housing and Communities (High Court, 2024), represented the Secretary of State in an appeal under s.289 against the decision of an inspector to uphold an enforcement notice concerning the development of an agricultural site for commercial purposes.
  • Cheshire East BC v Maloney (High Court, 2024), represented the local planning authority in its application for committal for alleged breaches of an injunction.
  • Peak District NPA v Kohanzad (High Court, 2023), represented the local planning authority in its application for a final injunction to enforce against the development of a holiday retreat/eco-village in breach of planning control on a large site in the Peak District National Park.
  • Brent LBC v Algul and N.R. Algul Limited (Crown Court, 2023), represented the Defendants in a complex prosecution concerning multiple enforcement notices.
  • R (Dhanji) v Secretary of State for Levelling Up, Housing and Communities and Harrow Council (High Court, 2023), represented the Claimant in conjoined s.288 and 289 appeals involving developments at his residential property.
  • HHM 20 Ltd v Manchester CC (Magistrates’ Court, 2023), represented the Appellant owner of a Grade II listed theatre challenging a s.215 notice that required extensive works.

Environment

Howard’s environmental planning practice encompasses environmental work that is both intrinsic to the planning process and separate to it.

Within the planning context, Howard regularly deals with issues such as environmental impact assessment (EIA) and biodiversity net gain (BNG). He further deals with planning applications for environmental matters such as waste disposal operations and minerals projects.

More broadly, he has advised and represented clients in relation to other environmental matters, including statutory nuisance, environmental permits, enforcement action, and criminal prosecutions.

Since 2021, he has organised the United Kingdom Environmental Law Association (UKELA) Moot.

  • Nuneaton and Warwickshire Wildlife Sanctuary v Nuneaton and Bedworth BC (Magistrates’ Court, 2024), represented the Defendant local authority in a challenge to an abatement notice.
  • Environment Agency v Himley Environmental Limited (High Court, 2023), represented the Defendant company in injunctive proceedings concerning two enforcement notices.

Biodiversity Net Gain

Howard has advised developers and local planning authorities in relation to biodiversity net gain in the context of planning appeals. With the statutory requirement to demonstrate a biodiversity net gain of 10%, this is an issue which routinely arises and Howard is well-experienced in dealing with it.
