Harrison Burroughs is a sought after business and property practitioner and accepts instructions in all areas of commercial, property and chancery law. He represents companies, individuals and partnerships across a wide spectrum of disputes.

Harrison has a busy practice and appears in the High Court and County Court in a variety of trials and interlocutory hearings. He acts at all stages of claims and frequently deals with high value matters, including those valued at over £1 million.

Harrison has acted in claims in the High Court in London, and the Business and Property courts around the country. His most recent cases include an application to set aside an expert report on a property valued at up to £1.5m; a partnership dispute worth over £300,000; a two-day multi-track trial in a construction dispute; a TOLATA claim concerning agricultural land in Wales; and a High Court application to annul the bankruptcy of a national TV presenter.

Harrison is equally experienced in all forms of ADR and accepts instructions to attend mediations and joint settlement meetings. Recent mediations have included a highly-charged dispute concerning over £200,000 of loans between ex-partners.

Academically, Harrison has received numerous scholarships and legal awards. Prior to coming to the Bar, he acted as paralegal to the Chief Executive of a large Midlands law firm, specialising in high-value commercial disputes.

Harrison has a particular interest in banking and finance law and has written a number of articles on the subject. He is Secretary of the Midlands Commercial and Chancery Bar Association.

During his undergraduate degree, Harrison undertook an internship in the legal department of an international air transport technology company. He gained exposure to International commercial contracts and niche issues such as trade sanctions.

Banking, Finance & Financial Regulation

Harrison has extensive experience in banking and finance litigation and is well versed in common issues that arise in this area. He acts in disputes concerning commercial and consumer finance and represents banks, pension companies, finance providers, and individuals.

Harrison has substantial experience in claims involving undisclosed commission paid to brokers of finance agreements. He deals with both ‘secret’ and ‘half secret’ commission claims, as well as disputes as to unfairness under the Consumer Credit Act 1974. In particular, Harrison has appeared in numerous vehicle finance commission disputes, both at trial and at interlocutory hearings. He is also comfortable with disputes concerning PPI policies.

Harrison has a growing practice in cases involving the Financial Services and Markets Act 2000, including disputes concerning the regulation of financial products and activities.

Harrison has a particular interest in the academic side of banking and finance law and regularly writes articles on the subject. His most recent article considered the application of Philipp v Barclays Bank [2023] UKSC 25.

Commercial Litigation

Harrison has a strong commercial practice, with extensive experience of claims for breach of contract, professional negligence, unjust enrichment, misrepresentation, and conversion. He represents companies, individuals and partnerships in the full spectrum of commercial claims.

Harrison is keenly aware of the commercial realities involved in this area of litigation and is experienced at giving pragmatic advice.

Prior to joining No5, Harrison worked as a paralegal to the Chief Executive of a large Midlands law firm, specialising in commercial and banking law. Through this role he gained experience of a wide range of disputes and developed a keen understanding of the practical issues facing corporate clients.

Company & Partnership

Harrison has developed a strong practice in company and partnership law, which complements his experience in commercial litigation.

Experience includes:

  • Acting for a director threatened with a High Court injunction regarding a disputed removal of another director, along with the freezing of bank accounts.
  • Advised a commercial client as to a claim against an insolvent company and, inter alia, its directors, following non-payment under a contract.
  • Represented the Claimant in a partnership dispute concerning profits of £300,000.
  • Advised and drafted proceedings in a partnership dispute valued at over £100,000. The Defendant was alleged to have fraudulently hidden profits.
  • Harrison is well versed in dispute concerning shareholders, directors, and external parties with an interest in a company. He has experience in claims made under the Companies Act 2006, including unfair prejudice petitions.

Insolvency

Harrison has a strong insolvency practice, and he is experienced in the crossover with other commercial disputes. Harrison acts in both personal and corporate insolvency litigation. He has extensive experience of claims under the Insolvency Act 1986 and the interplay with the Companies Act 2006, including for wrongful trading, fraudulent trading, and breach of directors’ duties. He acts for creditors, debtors, liquidators and trustees in bankruptcy.

Harrison appreciates the commercial realities of this area of litigation and is able to give pragmatic advice on legal solutions.

Professional Negligence

Harrison has extensive experience of professional negligence claims, including against solicitors, estate agents, and surveyors.

Harrison is familiar with the interplay with other areas of law, including contractual claims and issues under the Defective Premises Act 1972.

Real Estate

Harrison acts in all areas of real estate and property law. He frequently acts in cases regarding high value property, including in excess of £1 million. Harrison has extensive experience of claims for possession, forfeiture of leaseholds, orders for sale, disputes of ownership, and disputes of boundaries.

Harrison represents landlords, tenants, companies and local authorities across the spectrum of disputes. He is happy to advise on non-contentious issues, as well as litigation disputes.

Notable Business & Property Cases



Represented the applicant in an action to enforce a Tomlin order concerning property valued at £1.5m.



Acted in a TOLATA claim for an order for sale of property of £1.4m.



Represented the Claimant in a partnership dispute concerning profits of £300,000.



Defended a claim brought in conversion and tortious interference with a classic Porsche car. The vehicle in question was valued at over £175,000.



Appeared in the High Court in London in an application to annul the bankruptcy of a national TV presenter.



Second junior in a Court of Appeal case regarding a multi-million pound breach of contract. Dealt with issues of exclusivity, implied terms, and whether the contract was ‘relational’.



Acted in the High Court in a claim for the removal of joint executors and account of the deceased’s estate.



Represented the Claimant in a claim for unpaid loans amounting to over £200,000 made over the course of a decade.


Inheritance Act Disputes

Harrison has a strong practice in disputes concerning inheritance, trusts and estates. He deals with claims such as the removal/substitution of executors, TOLATA matters, Inheritance Act 1975 claims, and disputes as to the validity of wills. He frequently deals with high-value claims.

As a specialist business and property practitioner, Harrison is well-experienced in the crossover trusts and estate disputes have with other areas. Harrison has experience of all forms of alternative dispute resolution and regularly acts in high-value mediations.

Notable Inheritance Act Disputes Cases



Advised, drafted and appeared in a TOLATA claim concerning a family home which dealt with niche issues such as the valuation of a property classed as a rural enterprise dwelling.



Acted in the removal of an executor in an estate valued at over £1m.



Acted in a TOLATA claim for an order for sale of property of £1.4m.



Appeared in High Court litigation in London seeking an account and inquiry into the value of an estate and a personal representative’s conduct.



Acted in a successful claim against an executor for breach of trust, resulting in loss to a residuary estate.



Acted for the beneficiary of a will in a negligence claim against the deceased’s former solicitors, following a failure to sever a joint tenancy. The interest was valued at over £100,000.



Successfully resisted possession of a property used for domestic and agricultural purposes. Drafted the defence and counterclaim asserting a beneficial interest in the property by means of a constructive trust.
