Elliott Clifton-Thompson accepts instructions at all levels of Personal Injury, Clinical Negligence and Credit Hire work, and has a diverse practice across those areas acting for both Claimants and Defendants.

Elliott come to the Bar with a wealth of experience as a Solicitor, specializing in catastrophic brain and spinal cord injury before joining Chambers.

Elliott has specific experience with Inquest work and fatal accident claims and has experience in the First Tier Tribunal, Criminal Injuries Compensation chamber.

Elliott has written articles in the field of personal injury and is closely involved with associated brain injury charities, having sat in positions of office for multiple Headway committees.

Expertise

Personal Injury

Elliott has extensive experience in personal injury litigation and accepts instructions for both Claimants and Defendants. The breadth of his experiences spans employer’s liability, public liability, occupier’s liability and road traffic accidents and he is experienced in dealing with complex liability disputes requiring a forensic analysis of extensive disclosure.

Elliott has experience working on cases where liability is dealt with as a preliminary issue, requiring work with non-medical experts, including engineering experts, electrical experts and accident reconstruction experts.

Elliott has specific experience in high-value, complex, quantum disputes, including catastrophic brain and spinal cord injury. Elliott has experience with mild traumatic brain injury cases as well as functional neurological disorder injuries. He has further experience with chronic regional pain syndrome cases and is comfortable working alongside a multi-disciplinary team-led rehabilitation package.

Elliott is experienced in high-value drafting and accepts instructions to prepare detailed sets of pleadings in catastrophic injury litigation.
Elliott accepts instructions at all levels of personal injury and has a busy Court and papers practice in the Fast and Multi-tracks.

Catastrophic Injury

Elliott has specific experience working in catastrophic injury, in particular brain injury litigation. Elliott has extensive knowledge of brain injury and is experienced in working with Claimants suffering from a range of cognitive deficits, executive functioning difficulties and behavioural challenges.

Elliott has worked closely with busy rehabilitation packages and appreciates the need for a rehab-driven approach to litigation.

Elliott has further experience in poly-trauma orthopaedic cases, requiring a forensic examination of medical evidence to identify how best to extrapolate a Claimant’s needs from a complex medical picture.

Credit Hire

Elliott is experienced in credit hire litigation, frequently acting for both Claimants and Defendants. Elliott stays abreast with this fast-developing area of law, ensuring that the most up-to-date decisions are appropriately applied.

Elliott has a busy practice in credit hire and accepts instructions for both small-claim and fast-track trials, together with interlocutory and costs-only hearings.

Notable Personal Injury Cases



Prior to joining Chambers Elliott worked on the reported case providing a comprehensive summary of the common law defence of illegality: RO (by his Litigation Friend, MI) v Freddy Gray; and the MIB [2021] EWHC 2770 (QB)

Elliott accepts instructions across a wide range of Commercial, Property and Inheritance disputes. He is experienced in providing advocacy, drafting and written advice, as well as advice in conference should that be preferred. Elliott has a diligent and thorough approach to his work and is comfortable when dealing with complex and document heavy matters. His experience includes dealing with the following:

  • Consumer contractual disputes for both the provider and customer;
  • Telecommunications contractual disputes;
  • General contract disputes;
  • Residential and commercial property disputes for both landlord and tenant;
  • Issues arising from land ownership and boundary disputes;
  • Unregulated collective investment scheme disputes;
  • Issues of shareholder disputes and partnership disagreements;
