Insolvency

Annie regularly appears in the Winding up list and bankruptcy list. She has dealt with orders for sale by trustees in bankruptcy and applications to set aside statutory demands.

Annie acted as a junior, led by Alexander Heylin, on a 10 day High Court trial in a case where liquidators were claiming £3m under section 213 Fraudulent Trading, section 238 Transactions at an undervalue, Dishonest Assistance and a claim under section 39 of the Financial Services and Marketing Act. Alexander and Annie successfully defended the claim on behalf of the 6th and 7th Respondents.

Professional Negligence

Annie has acted and advised in professional negligence disputes in a number of areas including in claims against solicitors, surveyors and professional advisors, including in the pension context.

Real Estate

Annie has acted and advised on a number of both residential and commercial property disputes including:

  • boundary disputes
  • forfeiture and relief from forfeiture extension of leases
  • legal and equitable easements prescriptive rights
  • adverse possession licence agreements

Inheritance Act Disputes

Annie has acted in a number of cases relating to the Inheritance (Provision for Family Dependants) Act 1975, disputes between beneficiaries and executors concerning the administration of the estate and disputes between beneficiaries and trustees in co-ownership disputes.

In a recent case, Annie has acted for a husband in a disputed claim against his deceased wife’s estate, securing over half a million pounds at a successful mediation.

Annie has acted for Claimants and Defendants in TOLATA disputes between co-owners as well as claims for constructive and resulting trusts.
