Jonas Hankin KC led Chloë Ashley in the prosecution of Zara Arsalan, who was convicted before Coventry Crown Court of the murder of her two-month-old daughter, Harleen Bains.

On 23 July 2020, Harleen collapsed at the family home in West Bromwich and died the following day from catastrophic head injuries. Post-mortem and radiological investigation revealed complex, multifocal skull fractures; extensive intracranial and spinal subdural haemorrhage; severe retinal haemorrhaging; a fractured clavicle; and multiple rib fractures, including a healing posterior rib fracture sustained several days prior to death. There was no evidence of natural disease or any underlying pathology capable of accounting for this constellation of injuries.

The prosecution relied upon expert evidence in paediatric neuropathology, neuroradiology, ophthalmology and bone pathology. That evidence was clear and consistent. The pattern, distribution and severity of the injuries were incompatible with a low-level fall or normal handling. Rather, they demonstrated the application of severe force, comprising high-energy impact, violent acceleration-deceleration forces and forceful compressive loading of the chest and spine. The injuries were inflicted shortly before collapse and would have resulted in immediate neurological compromise and rapid cardiorespiratory deterioration.

During the investigation, the defendant provided three materially different accounts in interview as to the mechanism of injury. Each was inconsistent with the objective medical findings. At trial, she elected not to give evidence.

Following a six-week trial before Mr Justice Cavanagh, the jury returned a unanimous verdict of murder. Sentencing is to take place in March 2026.

Jonas Hankin KC and Chloë Ashley were instructed by Paul Farrow of the CPS Complex Casework Unit.
