In every case that comes before the court, the first question is whether the court has the authority to grant the orders that the applicant seeks. In short, does the court have jurisdiction? In this case, regrettably, it is only now that this question is being addressed, some thirty-six weeks into proceedings under Part IV of the Children Act 1989 (hereafter “the 1989 Act”) that have a statutory time limit of twenty-six weeks.
