No5’s Sajid Suleman and Hannah Jones of Rosenblatt Law have published an article in the New Law Journal looking at how courts approach arbitration clauses in insolvency proceedings.
The article takes a comparative look at the common law jurisdictions of England and Wales, the British Virgin Islands, the Cayman Islands, Hong Kong and Singapore, particularly in light of the recent seminal Privy Council decision in Sian Participation Corp v Halimeda International Ltd.
