David represented the Claimant in the case of R (Draper) v Secretary of State for Justice [2024] EWHC 1892 (Admin). The case was heard by Mr Justice Turner in Manchester. It challenged the Secretary of State’s decision to reject the recommendation of the Parole Board that the Claimant, a serving prisoner, should be moved to open conditions in the Prison Estate. In doing so, Tuner J was very careful not to engage in a detailed consideration of the developing jurisprudence in this area, which will be considered by the Court of Appeal in October 2024. The judge held the decision could and should be quashed on the simple basis that it was irrational and inadequately reasoned.
