Richard Grimshaw has recently represented a surgeon at trial who had operated on a patient in the private sector. The case concerned whether the patient was offered an appropriate procedure and was consented appropriately. The Defendant became concerned as to whether the Claimant was exaggerating his claim, and ‘fundamental dishonesty’ was raised as an issue. The case went to a trial listed for 7 days but the Claimant discontinued his claim after day 3.
