No5 Chambers’ Barristers Ramby de Mello, leading S. Chelvan, have been instructed by David Tang of David Tang and Co to seek a declaration from the Divisional Court on the requirement of approval from HM Treasury and an Act of Parliament to withdraw the UK from the European Economic Area Agreement 1994.  Pursuant to Article 127, the notice for withdrawal under the Agreement is 12 months.  The four claimants plead notice can only be provided through an Act of Parliament and not by the government exercising the Royal Prerogative.   Claim forms were issued this morning with the four Claimants acting as proposed Second Claimants to the proposed Lead Claimants, Adrian Yalland and Peter Wilding.
