Richard Humphreys QC has been successful in achieving planning permission for Aldi Stores Ltd for a new supermarket in North-East Leicester (appeal decision letter dated 29th March 2016). Despite the site being located on a business park, it was shown that development of the site for industrial use would not be viable, thus that there was no reasonable prospect of the site being used for that purpose (NPPF paragraph 22) and that the site should therefore be released.
