Rikko Marks, 22 was jailed for the murder of Adrian Locke in January 2013. He was not accused of wielding the knife, but of encouraging his friend, Micah Golding.
He is now trying to overturn his conviction, and has been granted permission for a full appeal by three Judges, who ruled that his complaints about his trial were ‘arguable’.
Lawyers for Marks, including Adrian Keeling QC, contended that the way the trial Judge directed the jury on how to come to verdicts on the two defendants may have been confusing, as the legal instructions effectively removed the possibility of Marks being found guilty only of manslaughter.
Lady Justice Macur, Mr Justice Cranston and Judge Francis Gilbert QC granted permission for a full appeal. No date for the appeal has been set yet.
