Philip Dayle, acting for the Public Guardian, successfully resisted an application for costs by the donee of a lasting power of attorney, who complained that that the Public Guardian had used its statutory power to investigate unreasonably.
Senior Judge Lush described the case as: “The first occasion on which a respondent has sought an order for costs against the Public Guardian in respect of a safeguarding application regarding the respondent’s conduct as a donee of a lasting power of attorney.
