The admissibility of settlement offers and ‘off the record’ conversations in proceedings before an Employment Tribunal is regulated by:
– the ‘Without Prejudice’ rule
– Section 111A of the Employment Rights Act 1996 (an amendment to the 1996 Act introduced in 2013).
