The company faced an allegation contrary to section 3 of the Health and Safety at Work etc Act 1974 after an accident in which an employee of an independent contractor was seriously injured whilst replacing a conveyor belt at one of their sites. The company was acquitted after trial. In the course of a detailed judgement the Judge exonerated the company of any blame for the injuries. The company had an exemplary health and safety record and took all reasonably practicable steps to ensure the safety of employees and other persons.
