Sajid Ali, 41, Aston, has had his conviction of rape quashed after three Court of Appeal judges heard that jurors were not told the alleged victim had made a previous false claim of indecent assault.
The Criminal Cases Review Commission discovered the mistake made by West Midlands Police, who failed to find any trace of the previous incident during checks. The Court of Appeal heard that the background information about the alleged victim should have been made available at the trial.
Mr Ali said he had suffered “five years of hell” since being arrested, including spending two and a half years in jail.
Lord Chief Justice Lord Thomas quashed the conviction and ordered that there should not be a retrial.
