Three men have this week been convicted of fraudulent trading at Stafford Crown Court.
Simon Foster, 48, Lichfield, who was the businesses principal shareholder, Stuart Cox, 49, Sutton Coldfield, a partner in the business and Johnathan Husselbee, 36, Tamworth, the office manager, had all denied charges but were found guilty by the jury after a 3-month trial.
Following numerous customer complaints, Police and Trading Standards investigated the business, Spaserve. The company was found to have lied to customers, and out of 2,000 sold hot tubs only approximately 1,600 were delivered.
Adrian Keeling QC, prosecuting, said “It was not run as a proper and honest business, it was run, first and foremost, as a source of income for these defendants. It was run as a ‘cash cow’”.
Judge Amjad Nawaz remanded the three men on bail for reports, but warned that all face a custodial sentence, to be decided at a later date.
